Application for Registration of a Trade Mark.

NOTICE is hereby given that Messieurs DUNN and LYONS,
of 162, King Street, Sydney, in the Colony of New
South Wales, Solicitors, have applied, on behalf of WILLIAM
FRANK WHITTIER and WILLIAM P. FULLER, trading as
Whittier, Fuller, & Co., at San Francisco, California, and
at 257, George Street, Sydney, in the said Colony of New
South Wales, to register, under "The Trade Marks Act,
1866," a trade mark of which the following is a descrip-
tion:—
Description of Trade Mark.
A circle in the centre of which is the representation of an
indiarubber tree, from whose trunk a native is supposed to
be drawing the gum or sap, while two others on the right are
laden with buckets of this gum or sap.
In the background is seen the profile of two pyramid-
shaped hills, the junction of which on the sky-line is bisected
by the upper part of the trunk of the indiarubber tree.
Between the above hills and said tree, and to the right of
the latter, is the representation of an elephant.
This fills up the central part.
On the extreme right of said circle are representations of
barrels and tins supposed to contain Pacific rubber paint
packed for sale.
Over these packages are the words "Waterproof and
Economical."
On the extreme left of the above-mentioned circle is the
representation of a house with a gable roof, with foliage in
the background projecting at the sides. Above the roof of
said house are the words "Durable and Elastic."
This circle is divided by two curved lines into three parts,
within which are the above-mentioned representations.
At the bottom of these two curved lines are representations
of two broad-leaved and sharp-pointed plants of the cactus
genera, one at the lower extremity of each curved line,
almost at the point where said line joins the circumference
of said circle.
At the bottom of the said indiarubber tree, and quite in
the foreground, are the words "Trade mark," enclosed within
a curved line.
Without the circumference of the above-mentioned circle
is the circumference of another of larger diameter. Between
the two circumferences are the words "Pacific Rubber Paint,
manufactured only by Whittier, Fuller, & Co., San Fran-
cisco, Cal. Patented June 22, 1869; April 4, 1871." The
words "Manufactured only by," and "Patented June 22,
1869; April 4, 1871," are in much smaller type than the
words "Pacific Rubber Paint" and "Whittier, Fuller, & Co,"
