which the lands comprised in any village settlement shall be disposed of, and the mode of payment for the same: And whereas His Excellency the Governor of the Colony of New Zealand has, by Proclamation in the New Zealand Gazette, bearing date this twenty-eighth day of June, set apart the lands enumerated in the Schedule hereto for sale as a village settlement:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the powers and authorities conferred upon him by the hereinbefore in part recited Act, and by and with the advice of the Executive Council of the Colony of New Zealand, doth hereby fix the following terms and conditions upon which the said village settlement shall be disposed of, and the mode of payment for the same, that is to say,—

  1. The lands enumerated in the Schedule hereto shall be disposed of as small-farm allotments upon deferred payments.

  2. The day upon which the lands shall be open for application shall be Wednesday, the first day of August, one thousand eight hundred and eighty-three.

  3. The lands shall be sold upon deferred payments, and be subject to the provisions relating to suburban lands of Part III. of “The Land Act, 1877,” and to the provisions of section nine of “The Land Act 1877 Amendment Act, 1879.”

  4. No person shall be allowed to acquire more than one section.

  5. The prices stated in the Schedule hereto shall be the prices at which the lands shall be open for application.

  6. If there should be more than one application for any allotment, the right to occupy the same shall be determined by lot amongst the applicants.

  7. Each applicant will be required to make the declaration prescribed by section sixty-two of “The Land Act, 1877,” and shall at the time of application deposit with the Receiver of Land Revenue for the Otago Land District one-tenth of the price of the allotment. Such payment shall be deemed to be a discharge of the license-fee for the six months due on the first day of January, one thousand eight hundred and eighty-four.

  8. The purchaser of any lands described in the Schedule hereto, upon payment of the purchase-money, and also the fulfilment of the terms and conditions prescribed by “The Land Act, 1877,” “The Land Act 1877 Amendment Act, 1879,” and “The Land Act 1877 Amendment Act, 1882,” relating to land on deferred payments, will be entitled to his Crown grant, to be issued in the usual way, upon payment of the fees prescribed by law.

At the Government House, at Wellington, this twelfth day of June, 1883.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN pursuance and exercise of the powers vested in him by “The Public Works Act, 1882,” and of all other powers in anywise enabling him in this behalf, His Excellency Sir William Francis Drummond Jervois, the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby order that the Government work known as the Cambridge-Rotorua Road shall and may be constructed on or through the several parcels of land more particularly described in the Schedule hereto, and delineated in the plan marked P.W.D. 10013, deposited in the office of the Minister for Public Works at Wellington, in the Provincial District of Wellington, in the said colony.

SCHEDULE.

COMMENCING at a point on the south-eastern boundary of Section No. 5 of Maraeroa-Oturoa Block, No. 5478, in the Rotorua Survey District, and proceeding thence in a generally south-easterly direction for a distance of 8 miles 69 chains or thereabouts, and terminating at a point on the Rotorua and Tauranga Road, near the Ngungotaha Creek, passing in, into, through, or over the following lands: Native land and Maniaroa-Puruhā Block, No. 5171: the above-described road not to be less than 1 chain wide; as the same is more particularly delineated upon the plan marked P.W.D. 10013, deposited in the office of the Minister for Public Works at Wellington, in the Provincial District of Wellington.

Proclaiming the Taking and Laying-off of Roads over Lands in the Auckland Provincial District.

IN exercise and pursuance of all powers and authorities enabling me in this behalf, I, William Francis Drummond Jervois, the Governor of the Colony of New Zealand, do hereby proclaim that the several lines of road described in the Schedule hereto have been duly taken and laid off through the lands specified in a warrant of the date given in the said Schedule.

SCHEDULE.

ALL those parcels of land in the Provincial District of Auckland, containing by admeasurement 20 perches, 29 perches, and 4 acres 1 rood 33 perches respectively, more or less, situated in the Waihou Survey District, and being portions of road-lines varying in width, and traversing the Onetai No. 2A Block, No. 2900A:—

Portion containing 20 perches: Commencing at the north-eastern angle of the above-mentioned block; and thence continuing southerly for a distance of 515 links or thereabouts along the eastern boundary.

Portion containing 29 perches: Commencing on the eastern boundary of the above-named block at a distance of 2700 links or thereabouts from its south-eastern angle; and thence continuing westerly for a distance of 183 links to its junction with another road.

Portion containing 4 acres 1 rood 33 perches: Commencing on the southern boundary at a distance of 900 links or thereabouts from its south-eastern angle; and thence continuing north-easterly for a distance of 4780 links or thereabouts to its intersection by the eastern boundary: be all the aforesaid linkages more or less; as the same is delineated on Plan No. 3056, deposited in the Survey Office at Auckland.

Date of warrant, 29th August, 1882.

All that parcel of land in the Provincial District of Auckland, containing by admeasurement 3 acres and 32 perches, more or less, situated in the Waihou Survey District, and being a road-line 100 links wide traversing the western portion of the Hikutaia No. 1 Block, No. 3038. Commencing on the northern boundary at a distance of 1260 links from the north-western angle; and thence continuing southerly generally for a distance of 3200 links or thereabouts to the south-western boundary, and at a distance of 1100 links or thereabouts from its south-western angle: be all the aforesaid linkages more or less; as the same is delineated on Plan No. 3056, deposited in the Survey Office at Auckland.

Date of warrant, 29th August, 1882.

All that parcel of land in the Provincial District of Auckland, containing by admeasurement 6 acres 1 rood 27 perches, more or less, situated in the Thames and Waihou Survey Districts, and being a road-line 100 links wide traversing the Waikoropupu Block, No. 1189. Commencing at a point on the north-western boundary of the aforesaid block at a distance of 3200 links or thereabouts from its northernmost angle; and thence continuing south-easterly generally for a distance of 6430 links or thereabouts to the south-eastern boundary, and at a distance of 4600 links or thereabouts from its south-eastern angle: be all the aforesaid linkages more or less; as the same is delineated on Plan No. 3056, deposited in the Survey Office at Auckland.
