ORDER IN COUNCIL.
At the Government House, at Wellington, this
seventeenth day of May, 1881.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by Order in Council dated the
thirtieth day of October, one thousand eight
hundred and eighty, His Excellency the Adminis-
trator of the Government of New Zealand, in exercise
and pursuance of the powers vested in him by "The
Land Transfer Act 1870 Amendment Act, 1880"
(hereinafter called "the said Act"), with the advice
and consent of the Executive Council of the colony,
ordered that there should be paid to the several
persons in respect of the several matters and things
specified in the Schedule thereto the fees specified in
the said Schedule: And whereas it is expedient to
alter the said Order in Council in manner hereinafter
expressed:
Now, therefore, His Excellency the Governor of the
said colony, in exercise and pursuance of the powers
vested in him by the said Act, and with the advice
and consent of the Executive Council aforesaid, doth
hereby revoke and annul so much of the recited
Order in Council as provides for the payment of fees
to Registrars of the Supreme Court under the provi-
sions of the said Act; and in further exercise of the
powers vested in him by the said Act, and with the
advice and consent of the Executive Council aforesaid,
doth hereby order that there shall be paid to the
District Land Registrar, to and for the use of Her
Majesty, in respect of the registration of any transfer
executed by any Registrar or Deputy Registrar of
the Supreme Court under the provisions of the said
Act, in addition to the registration fees payable under
"The Land Transfer Act, 1870," the following fees,
that is to say,-
If not exceeding £200, 1 per cent. on purchase-
money expressed in such transfer.
If exceeding £200, 1 per cent. on £200, and ½ per
cent. on remainder of purchase-money.

Terms and Conditions of Sale of the Village Settle-
ment of Mount Hyde, Otago Land District.

At the Government House, at Wellington, this
seventeenth day of May, 1881.

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by the twenty-first section of "The
Land Act 1877 Amendment Act, 1879," it is
enacted that the Governor in Council may fix the
terms and conditions upon which the lands comprised
in any village settlement shall be disposed of, and
the mode of payment for the same: And whereas
His Excellency the Governor of the Colony of New
Zealand has, by Proclamation in the New Zealand
Gazette, bearing date this nineteenth day of May,
set apart the lands enumerated in the Schedule
hereto for sale as a village settlement:
Now, therefore, His Excellency the Governor of
the Colony of New Zealand, in pursuance and exer-
cise of the powers and authorities conferred upon
him by the hereinbefore in part recited Act, and by
and with the advice of the Executive Council of the
Colony of New Zealand, doth hereby fix the following
terms and conditions upon which the said village
settlement shall be disposed of, and the mode of pay-
ment for the same, that is to say,-
- The lands enumerated in the Schedule hereto
shall be disposed of as small-farm allotments. - The day upon which the lands shall be open for
application shall be Tuesday, the twenty-eighth day
of June, one thousand eight hundred and eighty-
one, at the Land Office, Dunedin. - The lands enumerated in the Schedule hereto
shall be sold on deferred payments, subject to the
provisions relating to suburban lands of Part III. of
"The Land Act, 1877," and to the provisions of sec-
tion nine of "The Land Act 1877 Amendment Act,
1879." - No person shall be allowed to acquire more than
one section upon deferred payments. - The price stated in the Schedule hereto shall
be the price at which the lands shall be open for
application. - If there should be more than one application
for any allotment the right to occupy the same shall
be determined by lot amongst the applicants. - Each applicant will be required to make the
declaration prescribed by section sixty-two of "The
Land Act, 1877," and shall at the time of application
deposit with the Receiver of Land Revenue for the
Otago Land District one-tenth of the price if the area
of the allotment is twenty acres or under. Such
payment shall be deemed to be a discharge of the
license-fee for the six months ending the thirty-first
day of December, one thousand eight hundred and
eighty-one. - Upon the fulfilment of the terms and conditions
prescribed by "The Land Act, 1877," and "The
Land Act 1877 Amendment Act, 1879," relating to
land on deferred payments, the purchaser will be
entitled to his Crown grant, to be issued in the usual
way upon payment of the fees prescribed by law.
