able James Temple Fisher, the Minister acting for
the Minister for Public Works, deposited in the
office of the Registrar of the Supreme Court at
Hokitika, in the Provincial District of Westland;
the total length being 9 chains or thereabouts.

Her Majesty's Colony of New Zealand

A PROCLAMATION.

IN pursuance and exercise of the powers and
authorities vested in me by "The Protection of
Animals Act, 1873," and "The Abolition of Provinces
Act, 1875," I, James Prendergast, the Administrator
of the Government of the Colony of New Zealand,
do hereby proclaim and declare that the season in
which the native game specified in the third column
of the Schedule hereto shall be hunted, shot, taken,
or killed in any of the provincial districts mentioned
in the first column of the said Schedule shall be that
specified in the second column of the said Schedule.

Terms and Conditions upon which the Malvern
Water-race is vested in the Corporation of the
County of Selwyn.

ORDER IN COUNCIL.

At the Government House, at Wellington, this
twenty-fifth day of March, 1879.

Present :

HIS EXCELLENCY THE ADMINISTRATOR OF THE
GOVERNMENT IN COUNCIL.

WHEREAS by "The Malvern Water-race Transfer
Act, 1878," it is enacted that the Governor, by
Order in Council, may vest the Malvern Water-race
in the Corporation of the County of Selwyn, upon
such terms and conditions as the Governor in Council
thinks fit :

Now, therefore, His Excellency the Administrator
of the Government, by and with the advice and
consent of the Executive Council of the Colony of
New Zealand, doth, by this present order, vest the
Malvern Water-race, as the same is defined by the
said Act and in the Schedule hereto, in the Chair-
man, Councillors, and inhabitants of the Selwyn
County, upon the following terms and conditions,
namely:β€”

  1. Whenever a public road crosses the land de-
    scribed in the Schedule hereto the County Council
    of Selwyn shall erect a substantial cart bridge, to the
    satisfaction of the District Engineer of the Public
    Works Department at Christchurch, over the portion
    of the land occupied by the water-race.

  2. All water required by the Public Works De-
    partment for railway purposes shall be supplied free
    of charge.

  3. If at any time it is made to appear to the satis-
    faction of the Governor in Council that the works in
    connection with the water-race are not maintained
    in good repair and condition, the Governor, with the
    advice of his Executive Council, may resume posses-
    sion of the lands vested in the County Council afore-
    said by this present Order in Council, and be pos-
    sessed of the water-race and all material and plant
    connected therewith.

SCHEDULE.

ALL that parcel of land in the Malvern District,
Provincial District of Canterbury, being part of a
reserve known as the Coal Tramway Reserve (Rol-
leston to River Kowai), and consisting of a strip of
land seventy-five (75) links wide, the southern
boundary line whereof is parallel to and seventy-five
(75) links distant from the southern boundary line
of the said reserve, commencing at the eastern bank
of the River Kowai, and continuing easterly along
the said reserve to its junction with Reserve No.
487 (in red), a distance of about six hundred and
forty-three (643) chains.
