Approving of Plans of Waitara Wharf.

ORDER IN COUNCIL.

At the Government House, at Wellington, this
seventeenth day of December, 1879.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS certain plans of a wharf to be erected
at the Port of Waitara have been submitted
by the Waitara Harbour Board for the approval of
the Governor in Council, in accordance with the
provisions of "The Harbours Act, 1878," and it
having been made to appear to the Governor in
Council that the said works will not be or tend to
the injury of navigation:

Now, therefore, the Governor of the Colony of
New Zealand, by and with the advice and consent of
the Executive Council of the said colony, doth hereby
approve of plans of a wharf to be erected at the Port
of Waitara, as shown on plans marked M.D. 296, 297,
and 298, the said plans being deposited in the office
of the Marine Department, Wellington, subject,
however, to certain alterations and additions as
described in a memorandum from the Marine Engi-
neer to the Secretary to the Marine Department,
dated the fifteenth day of December, one thousand
eight hundred and seventy-nine, and marked
M. 79/3108, the said memorandum being deposited
in the office of the Marine Department aforesaid.

Orawaiti Public Cemetery brought under "The
Cemeteries Management Act, 1877."

ORDER IN COUNCIL.

At the Government House, at Wellington, this
twenty-second day of December, 1879.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by section thirty-nine of "The
Cemeteries Management Act, 1877," it is,
amongst other things, enacted that, where the Trus-
tees of any public cemetery, or the Trustees, Mana-
gers, or other persons having the care and control of
any other cemetery, burial-ground, or place of burial
heretofore established, shall be desirous of adopting
the provisions of this Act, or any of them, in the
place of any Act or Ordinance, or any provisions of
such Act or Ordinance, heretofore regulating the
management of any such last-mentioned cemetery,
burial-ground, or place of burial, the said Trustees,
Managers, or other persons may apply to the Governor
in Council in that behalf, who may thereupon cause
inquiry to be made in such manner as he shall think
fit as to the desirability of granting such petition,
and the Governor may, by Order in Council, direct
that the provisions of this Act, or any of them, shall

come into force in respect of any such cemetery,
burial-ground, or place of burial, or he may reject
any such application:

And whereas the Trustees of the Orawaiti Public
Cemetery have applied to the Governor to bring the
said cemetery under the provisions of the said Act,
and due inquiry has been made in pursuance of the
said thirty-ninth section as to the desirability of
granting such petition:

Now, therefore, His Excellency the Governor of
the Colony of New Zealand, in pursuance and exercise
of the powers and authorities vested in him, and by
and with the advice and consent of the Executive
Council of the said colony, doth hereby order and
direct that all provisions of "The Cemeteries Manage-
ment Act, 1877," shall come into force in respect of
the public cemetery at Orawaiti, in the Provincial
District of Nelson, and known as the Orawaiti
Cemetery, as the same is described in the Schedule
hereto: And in further pursuance and exercise of
the powers and authorities vested in me, I do, with
the like advice and consent as aforesaid, order and
direct that this order shall come into force on the
second day of January next.

SCHEDULE.

ALL that parcel of land situate in the Provincial
District of Nelson, being Section No. 62, Square 141,
Kawatiri District, and containing by admeasurement
3 acres 3 roods, be the same more or less. Bounded
on the North-east by Section 173, 600 links; on the
South-east by Crown land, 680 links; on the South-
west by the River Orawaiti; and on the North-west
by Crown lands and Section 173, 560 links: except-
ing always a public road, 1 chain in width, crossing
the said Section No. 62.

**Fixing Date and Place of Trial of Maori Prisoners
under "The Confiscated Lands Inquiry and Maori
Prisoners' Trials Act, 1879."

ORDER IN COUNCIL.

At the Government House, at Wellington, this
twenty-third day of December, 1879.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by "The Confiscated Lands Inquiry
and Maori Prisoners' Trials Act, 1879," it is,
among other things, enacted that, in order that
the peace of the colony may be preserved, the Go-
vernor in Council may fix the date of trial of certain
Natives who have been committed for trial at the
Supreme Court at Wellington and elsewhere in
respect of disturbances of public peace and other
offences, and may declare what number of such
Natives shall be tried at any one sitting of the said
Supreme Court, and any such order may alter or
vary as occasion shall require:

And whereas all the Natives so committed for trial
are now confined in the Mount Cook Prison at Wel-
lington, and it is expedient that the date of their
trial should be fixed as hereinafter mentioned:

Now, therefore, His Excellency the Governor of the
Colony of New Zealand, with the advice and consent
of the Executive Council of the colony, and in
exercise of the powers and authorities vested in him
by the said Act, doth hereby order that all the said
Natives so committed for trial, and confined in the
Mount Cook Prison aforesaid, shall be tried at the
Supreme Court at Wellington, and doth fix Monday,
