the Mayor, Councillors, and burgesses of the Borough of Sydenham, incorporated under the provisions of “The Municipal Corporations Act, 1876,” and the Road Board of the Avon District, incorporated under and by virtue of the provisions of an Ordinance of the Superintendent and Provincial Council of the Province of Canterbury, intituled “The Canterbury Roads Ordinance, 1872,” did, by three several deeds, dated respectively the twenty-third day of July, one thousand eight hundred and seventy-eight, and the fourth day of June, one thousand eight hundred and seventy-eight, and the first day of June, one thousand eight hundred and seventy-eight, and made respectively between them of the one part and the said Company of the other part, duly consent to the application contained in the said memorial:

Now, therefore, I, the undersigned, George Augustus Constantine, Marquis of Normanby, the Governor of the Colony of New Zealand, in pursuance and exercise of the power and authority in that behalf vested in me by “The Tramways Act, 1872,” and of all other Acts and authorities enabling me, do hereby authorize and empower the Canterbury Tramway Company (Limited), their successors or assigns (hereinafter called “the said Company”), to construct, make, and use in the City of Christchurch aforesaid and its vicinity, along the several routes hereinafter mentioned or any of them, a tramway of the gauge and subject to the regulations hereinafter contained, that is to say,—

The routes of the said tramway shall be—

I. A line from Cathedral Square, in the City of Christchurch, to the Papanui Railway Station, by way of Colombo Street, Whateley Road, the North Road, and Harewood Road.

II. A line from Cathedral Square, in the city aforesaid, by way of Colombo Street, Cashel Street, Oxford Terrace, Montreal Street, Tuam street, and the Lower Lincoln Road, to the Addington Railway Station.

III. A line from Cathedral Square, in the city aforesaid, along High Street and Manchester Street to the Christchurch Railway Station.

IV. A line from Cathedral Square, in the city aforesaid, along Colombo Street to the Agricultural Show-grounds, in the Borough of Sydenham, with power to make loop lines and sidings to places convenient for the traffic of the said Company.

V. The gauge of the said tramway shall be four feet eight inches and one-half of an inch.

VI. The rails to be used in the construction of the said tramway shall be of Bessemer steel, weight at least thirty-five pounds to the yard, and of the most approved plan.

VII. The rails of the said tramway shall be laid so that the centre between the rails shall be as near as possible to the centre line of the different streets, allowing for turns, curves, crossings, and side lines, and shall be kept on a level with the surface of such streets.

VIII. Proper passing places shall be constructed along the line of the said tramway for the purposes of such tramway, and so as to subserve the public convenience.

IX. The power to be used on the said tramway shall be mechanical or animal power, or both, at the option of the said Company.

And I do hereby direct that the said tramway shall be used both for passenger and goods traffic, and that the tolls and charges mentioned in the Schedule hereto shall be chargeable for the use of the said tramway, subject to the regulations in that behalf in the said Schedule contained.

And I do hereby order that the said Company may, for the purposes of the said tramway, acquire land not exceeding six acres in extent.

And I do hereby direct that the construction of the works authorized by this Order shall be substantially commenced within twelve calendar months from the date of this Order, and the said works shall be completed to the full extent of this Order at the expiration of twenty-four calendar months from the date of this Order, or at the expiration of such extended time as the Governor shall by Order in Council direct.

And I do hereby direct that, after the construction of the said works, the same and all plant used therewith shall at all times be kept by the said Company in good repair and condition, to the satisfaction of the Engineers or Surveyors of the respective local authorities aforesaid.

And I do hereby direct that the said Company shall at all times keep, use, and maintain a sufficient quantity of plant to subserve the purposes of the undertaking.

And I do hereby direct that the tramway shall be deemed completed for the purposes of this Order, and within the meaning of the said Act, when the same shall have been certified to be complete by an Engineer to be appointed in that behalf by me, such Engineer to be entitled for the purpose of such certificate, free of all cost, to inspect the same, and all the works connected therewith, and all the plant to be used in working the same.

And I do hereby direct that the said Company shall at all times conduct the business of the undertaking in such manner as shall not interfere with the ordinary traffic of the streets and public places through which the same shall extend, beyond such interference as is unavoidably incident to the business of the undertaking.

And I do hereby direct that the business of the undertaking shall at all times be carried on in a manner conducive to the public convenience.

And I do hereby direct that, except in so far as is expressly provided for in the said several deeds of consent, the provisions of the said Act are to be deemed to apply to any purchase of the tramway which may be made by the said local authorities.

And I do hereby direct that the Governor for the time being of the Colony of New Zealand shall be the sole judge of the fact whether the requirements of this Order have been complied with, and the said Governor for the time being may make inquiry into the matter in such way as he thinks fit, and his decision shall be final.

And, lastly, I do hereby order and declare that nothing herein contained shall be deemed in any way to interfere with, affect, or abridge any rights or powers that may be vested in Her Majesty the Queen, or in the Governor on her behalf, or otherwise under any Acts of the General Assembly, authorizing the construction of railways, or the erection or construction of any public work which Her said Majesty, or the Governor on her behalf, may be authorized to erect or construct. Nor shall Her Majesty, or the Governor, or any person on her or his behalf, be liable to pay to the said Company any compensation for injury done to the tramway by the construction of any such railway or any other public work as aforesaid, or for the loss of traffic occasioned thereby, or for the exercise of any such right or power as aforesaid.
