Rehearing of Native Land Claim.
NORMANBY, Governor.
ORDER IN COUNCIL.
At the Government House, at Wellington, this
nineteenth day of December, 1878.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by the fifty-eighth section of "The
Native Land Act, 1873" (hereinafter referred
to as "the said Act"), it is enacted that, upon the
application of any persons interested in any Native
land who may feel themselves aggrieved by the de-
cision of the Native Land Court in respect thereof,
the Governor in Council may order a rehearing of
any matter heard and decided under the provisions
of the said Act, within such a period of time from
the publication of the decision and memorial of
ownership, in manner in the said Act required, as
may be limited in such order; and, upon such order
being made, all proceedings theretofore taken by the
Court in such matter shall be annulled, and the case
shall commence de novo, and shall proceed in manner
provided by the said Act: Provided that no appli-
cation for a rehearing shall be entertained if it be
made after six months shall have elapsed from the
time of such publication:
And whereas at a sitting of the Native Land Court
of New Zealand, at Matata, in the District of Bay of
Plenty, in the Provincial District of Auckland, on
the seventeenth day of September, one thousand
eight hundred and seventy-eight, the claim of Pera-
niko Parakiri, and others, aboriginal natives of New
Zealand, to a piece of land called Kaingaroa No. 1
[advertised for hearing as Kaingaroa No. 2, in
the Kahiti o Niu Tireni, No. 5, of the 28th February,
1878], situate at Kaingaroa, in the said district, was
heard and decided, and a certain judgment was
thereupon given by the said Court:
And whereas on or about the twenty-seventh day
of September, one thousand eight hundred and
seventy-eight, an application was made, by and on
behalf of certain aboriginal natives claiming to have
an interest in the said land, for a rehearing of the
said claim, and it is expedient that the said claim
should be reheard before the said Court:
Now, therefore, His Excellency the Governor, in
exercise and pursuance of the above-recited power,
and by and with the advice and consent of the Exe-
cutive Council of New Zealand, doth hereby order
and direct that the said claim of Peraniko Parakiri,
and others to the piece of land aforesaid shall be
reheard as and in the manner provided by "The
Native Land Act, 1873," and doth also order that
such rehearing shall take place within one year from
the said twenty-seventh day of September, one
thousand eight hundred and seventy-eight.

ORDER IN COUNCIL.
At the Government House, at Wellington, this
twenty-fourth day of December, 1878.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by "The Public Reserves Sale Act,
1878," it is, among other things, enacted that
the lands described in the Schedule may at any time
after the passing of the said Act be sold by the
Governor, upon such terms as shall be regulated by
Order in Council:
And whereas the lands described in the Schedule
are required to be sold as town lands, and it is
expedient that the terms of such sale should be
defined:
Now, therefore, I, George Augustus Constantine,
Marquis of Normanby, Governor of the Colony of
New Zealand, by and with the advice and consent of
the Executive Council of the said colony, and in
exercise of the powers and authorities aforesaid, do
hereby order and direct that the land described in
the Schedule hereto shall be sold upon the following
terms, that is to say,-

The Governor shall cause the said land to be
sold by public auction, as town lands, at Invercargill,
on the twenty-sixth day of March, one thousand eight
hundred and seventy-nine. -
The sale shall be held by the Commissioner of
Crown Lands, and no land shall be sold at a less
price than thirty pounds per acre. -
Three months' notice of the date and place of
the sale shall be given by the Commissioner, by
advertisement in at least one newspaper circulating
at Invercargill, such notice to be inserted at least
once in each month. -
The lands shall all be sold in sections, as shown
upon the survey plan in the office of the Chief Sur-
veyor of Southland, at Invercargill. -
Sections forty-three and forty-four of "The
Land Act, 1877," are hereby declared to be part of
the terms upon which the said lands shall be sold,
and shall take effect accordingly, so far as the same
are consistent with these terms. -
Upon full payment of the purchase-money, the
purchaser will be entitled to his Crown grant, to be
issued in the usual way upon payment of the fees
prescribed by law.
SCHEDULE.
OTAGO-MATAURA FERRY.
(To be sold as Town Lands.)
ALL that parcel of land in the Provincial District
of Otago, containing by admeasurement thirty (30)
acres one (1) rood and eleven (11) poles, more or
less, being a part of that portion of Section 1, marked
A on the map of the Lyndhurst Survey District, and
bounded as follows: Towards the North-west by
Section No. 3 of said district, two thousand three
hundred and ninety-nine and six-tenths (2399%)
links; towards the North-east by Recreation Reserve
and Mataura Agricultural and Pastoral Reserve, one
thousand one hundred and ninety-nine and three-
tenths (1199%) links; again towards the North-west
by last-mentioned reserve and a road line, nine
hundred and sixty-seven and five-tenths (967%)
links; again towards the North-east by said Section
No. 3 of Lyndhurst District, two hundred and
twenty-five (225) links; towards the South-east by a
public road, three thousand three hundred and
ninety (3390) links; and towards the South-west by
Crown lands, one thousand and eighty (1080) links;
