clamation defining the middle line of the railway or
any part thereof, and may from time to time, by a
Proclamation revoking or amending such former
Proclamation, alter such line in any manner or to
any extent which may be found necessary for the
construction of such railway within the provisions of
the said special Act; and by the one hundred and
twenty-fifth section of the same Act, that the Minister
shall cause to be made and deposited in the office of
the Registrar of the Supreme Court such maps and
plans as may be necessary to explain the said line
and the land through which the same passes, and
such maps and plans shall be referred to in any such
Proclamation; and whereas the branch line of railway
from the main line (Amberley to the Bluff) to the
Green Island coal-pits is one of the railways specified
in the said Fourth Schedule, and the same is un-
finished, and it has been determined to construct and
maintain such railway:

Now, therefore, I, George Augustus Constantine,
Marquis of Normanby, the Governor of the Colony
of New Zealand, in exercise and in pursuance of the
powers and authorities conferred on me by "The
Public Works Act, 1876," and in exercise of every
other power and authority enabling me in that be-
half, do hereby proclaim and declare that the middle
line of the said branch line of railway shall be that
defined and set forth in the Schedule hereto, and that
the two termini of the said line shall be Section num-
bered 71, Block V., Lower Kaikorai District, and
Section 69, Block VII., Dunedin and East Taieri
District, Provincial District of Otago. The said
middle line and the land through which the same
passes are set forth in the map and plan marked
P.W.D. 6645, and authenticated for the purposes of
this Proclamation by the signature of the Honorable
James Macandrew, Minister for Public Works, and
which said map and plan is deposited in the office of
the Registrar of the Supreme Court at Dunedin.

SCHEDULE.

COMMENCING at a point on the Waitaki-Invercargill
Railway, said point being within the limits of devia-
tion of line of railway as described in the Proclamation
dated the twenty-second day of May, one thousand
eight hundred and seventy-one, and published in the
New Zealand Gazette No. 30, of the twenty-seventh
day of May, one thousand eight hundred and seventy-
one, situate in Section numbered seventy-one, Block
V., Lower Kaikorai District, distant about four and
one-half chains, more or less, from the eastern boun-
dary of the said Section numbered seventy-one, and
proceeding thence generally in a westerly direction for
a distance of two miles and forty-six chains or there-
abouts, and passing in, through, over, and into the
following territorial divisions, namely: Lower Kai-
korai District, Dunedin and East Taieri District, and
Green Island District, and terminating at a point
in Section numbered sixty-nine, Block VII., Dunedin
and East Taieri District, distant in a south-westerly
direction about six and one-half chains, more or less,
from the north-east angle of said Section numbered
sixty-nine; all within the Provincial District of
Otago, Colony of New Zealand; in the manner deli-
neated on the map and plan marked P.W.D. 6645,
signed by the Honorable James Macandrew, Minister
for Public Works, deposited in the office of the Regis-
trar of the Supreme Court at Dunedin, the total
length being two miles forty-six chains or there-
abouts.

Given under the hand of His Excellency the
Most Honorable George Augustus Con-
stantine, Marquis of Normanby, Earl of
Mulgrave, Viscount Normanby, and Baron
Mulgrave of Mulgrave, all in the County

of York, in the Peerage of the United
Kingdom; and Baron Mulgrave of New
Ross, in the County of Wexford, in the
Peerage of Ireland; a Member of Her
Majesty's Most Honorable Privy Coun-
cil; Knight Grand Cross of the Most
Distinguished Order of Saint Michael
and Saint George; Governor and Com-
mander-in-Chief in and over Her Majesty's
Colony of New Zealand and its Depen-
dencies, and Vice-Admiral of the same;
and issued under the Seal of the said
Colony, at the Government House, at
Wellington, this second day of November,
in the year of our Lord one thousand
eight hundred and seventy-eight.

Validating Assessment Roll of Whangapoua High-
way District.

NORMANBY, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this
second day of November, 1878.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREEAS the Highway Board of the Wha-
ngapoua Highway District, in the Provincial
District of Auckland, appointed one Renki Frederick
Luks to be the Valuer for the said district for the
purposes of "The Rating Act, 1876:"

And whereas the said valuer made and transmitted
to the said Highway Board a valuation list accord-
ingly: And whereas all things mentioned in the
twelfth section of the Act aforesaid with respect to the
said valuation list happened and were performed:
And whereas the Assessment Court held a sitting for
the purpose of hearing and determining objections to
the said list, but no objections were made: And
whereas the Judge of the said Court omitted to sign
the said valuation list: And whereas it is necessary
to provide for the completion and validation of the
said list as a valuation roll for the said district:

And whereas it is necessary to provide for placing
on the roll of county electors for the ridings within
which the said district is situate the names of the
persons appearing on such valuation roll:

Now, therefore, His Excellency the Governor of
the Colony of New Zealand, by and with the advice
and consent of the Executive Council of the said
colony, and in exercise and pursuance of the powers
and authorities vested in him by the second section
of "The Temporary Powers Act, 1878," doth hereby
make the regulations set forth in the Schedule here-
to: And in further pursuance and exercise of the
powers and authorities vested in him by the said
second section of "The Temporary Powers Act,
1878," and with the like advice and consent, doth
hereby validate all acts and things done in connection
with the matters and subjects referred to in and by
this Order in Council, and doth declare that the same
shall be good, valid, and effectual.

SCHEDULE.

  1. The valuation list prepared by the valuer of the
    Board as aforesaid shall be signed by

JACKSON KEDDELL, Esq., R.M.,

and when so signed shall, notwithstanding any error
or defect in making the same or otherwise, become
and be the valuation roll for the said Whangapoua
Highway District, and shall remain in force until a
fresh roll is made as by law required.
