plans to be deposited in some place in the road
district in which such lands are: And it is further
enacted that the said Minister shall cause a notice to
be gazetted, and to be twice publicly notified, stating
the place where such plans are open for inspection,
with a general description of the works proposed to
be executed and of the lands required to be taken;
and if after due consideration the said Minister is of
opinion that it is expedient that the proposed works
should be executed, and that no private injury will
be done thereby for which due compensation is not
provided by the Act now in recital, the land proposed
to be taken shall be taken in the following manner,
that is to say: The said Minister shall lay before
the Governor a memorial containing an accurate de-
scription of the lands proposed to be taken, together
with a map thereof, signed by the Surveyor-General
or some certificated surveyor as evidence of the
accuracy thereof; and the Governor in Council may
thereupon, if he think fit, by Proclamation gazetted
and publicly notified, declare that the said lands are
taken for the use of a railway, road, or other public
work, as the case may be; and from and after a date
to be named in the said Proclamation the lands
therein specified shall become absolutely vested in
fee-simple in Her Majesty, discharged from all mort-
gages, charges, claims, estates, or interests of what
kind soever, for the public use named in the said
Proclamation:

And whereas the Minister for Public Works has
laid before me the above memorial and the map
therein referred to, containing an accurate description
of the lands proposed to be taken under the authority
of the said Public Works Act, 1876," for a certain
public workβ€”to wit, the construction of a portion of
the railway from Kaiapoi to Eyreton (Eyreton Exten-
sion):

And whereas all the requirements and conditions
prescribed by the said Act prior to the taking of such
lands have been duly performed and fulfilled, and all
things have happened and been done to enable this
Proclamation to be issued:

Now, therefore, I, George Augustus Constantine,
Marquis of Normanby, Governor of the Colony of
New Zealand, by and with the advice and consent of
the Executive Council of the said colony, in exercise
and pursuance of the power and authority in me
vested by the said Act, and of any other power and
authority enabling me in that behalf, do hereby pro-
claim and declare that the lands described in the
memorial above written, and shown on the plan
thereto attached, are hereby taken for the purposes
of a railway; and that, from and after the day of the
date hereof, the lands described in the Schedule
hereto shall become absolutely vested in fee-simple
in Her Majesty, discharged from all mortgages,
charges, claims, estates, and interests of what kind
soever, for use as a railway.

SCHEDULE.

ALL that piece or parcel of land situate in the Cust
Road Board District, in the Provincial District of
Canterbury, Colony of New Zealand, containing by
admeasurement eleven (11) perches, more or less,
being portion of Rural Section No. 10038. Bounded
on the South-west by public road, two hundred and
ninety-nine (299) links; on the North-east by other
portion of said section, two hundred and eighty (280)
links; and on the South-east by public road, fifty-two
(52) links.

Also all that piece or parcel of land situate in the
Oxford and West Eyreton Road Board Districts, in
the Provincial District of Canterbury, Colony of
New Zealand, containing by admeasurement one (1)
acre two (2) roods and thirty (30) perches, more or

less, being portion of Rural Section No. 4643.
Bounded on the North-east by public road, six hun-
dred and seventy-two (672) links; on the North by
public road, one thousand five hundred and seven
(1507) links; on the South-west and South by other
portions of said section one hundred and thirty-two
(132) links, one thousand three hundred and seventy-
seven (1377) links, and six hundred and thirty-three
(633) links respectively.

Also all that piece or parcel of land situate in the
Cust Road Board District, in the Provincial District
of Canterbury, Colony of New Zealand, containing
by admeasurement two (2) two roods and thirty-one
(31) perches, more or less, being portion of Rural
Section No. 6416. Bounded on the South by public
road, nine hundred and seventy (970) links; on the
West by public road, ninety-six (96) links; on the
North by other portion of said section, nine hundred
and fifty-five (955) links; on the East by other
portion of said section, fifty (50) links.

The several parcels of land being more particularly
delineated upon the map marked P.W.D. 6569 hereto
attached.

Given under the hand of His Excellency the
Most Honorable George Augustus Con-
stantine, Marquis of Normanby, Earl of
Mulgrave, Viscount Normanby, and Baron
Mulgrave of Mulgrave, all in the County
of York, in the Peerage of the United
Kingdam; and Baron Mulgrave of New
Ross, in the County of Wexford, in the
Peerage of Ireland; a Member of Her
Majesty's Most Honorable Privy Coun-
cil; Knight Grand Cross of the Most
Distinguished Order of Saint Michael
and Saint George; Governor and Com-
mander-in-Chief in and over Her Majesty's
Colony of New Zealand and its Depen-
dencies, and Vice-Admiral of the same;
and issued under the Seal of the said
Colony, at the Government House, at
Wellington, this second day of November,
in the year of our Lord one thousand
eight hundred and seventy-eight.

Defining the Middle Line of Branch Line of Railway
from the Main Line (Amberley to the Bluff) to
the Green Island Coal-pits.

A PROCLAMATION.

WHEREAS by the one hundred and twenty-
second section of "The Public Works Act,
1876," it is enacted that every railway shall be made
only under the authority of a special Act, which
shall state as nearly as may be the line of the railway
and the two termini thereof; and by the one hundred
and twenty-third section of the same Act, that the
several railways specified in the Fourth Schedule to
the said Act shall be deemed to have been made, and
in so far as any of them are unfinished may be com-
pleted, under the provisions of the Act now under
recital, and the said Act shall be deemed to be a
special Act authorizing the construction of each of
the said railways; and by the one hundred and
twenty-fourth section of the same Act, that when
any railway is to be constructed under the provisions
of any special Act the Governor shall issue a Pro.
