Appointing a Day for Election of Members for the
Abbotsford Subdivision of the Kaikorai Road Board.

A PROCLAMATION.
WHEREAS by section ten of the "Otago Roads
Ordinance 1871 Amendment Ordinance,
1874," it is enacted that, if from any cause whatever,
the persons entitled to vote at any election for any
subdivision of any district shall fail or neglect to hold
an election of members of the District Board of such
district on the day appointed by the said Ordinance
for that purpose, it shall be lawful for the Super-
intendent, by Proclamation in the Gazette, to appoint
a day for the holding of such election, and an election
may be held upon the day so appointed, and the
election so held shall for all purposes whatsoever be
deemed to have been duly held on the day appointed
by the said Ordinance for holding the same : And
whereas the powers and authorities vested in the
Superintendent by the said section are by "The
Abolition of Provinces Act, 1875," now vested in the
Governor: And whereas the persons entitled to vote
in the election of members for the Abbotsford Sub-
division of the Kaikorai Road District failed on the
day appointed by the "Otago Roads Ordinance,
1871," to hold an election:
Now, therefore, I, George Augustus Constantine,
Marquis of Normanby, Governor of the Colony of
New Zealand, in pursuance and exercise of the
powers and authorities vested in me by the said
Ordinance and Act, do hereby proclaim and appoint
that an election shall be held on the fourth day of
October, one thousand eight hundred and seventy-
seven, at noon, at the Commercial Hotel, Green
Island, of three members of the Kaikorai Road
Board for the Abbotsford Subdivision of the said
Kaikorai Road Board District; and I appoint the
aforesaid Commercial Hotel, Green Island, to be the
place of polling at such election.
Given under the hand of His Excellency the
Most Honorable George Augustus Con-
stantine, Marquis of Normanby, Earl of
Mulgrave, Viscount Normanby, and Baron
Mulgrave of Mulgrave, all in the County
of York, in the Peerage of the United
Kingdom; and Baron Mulgrave of New
Ross, in the County of Wexford, in the
Peerage of Ireland; a Member of Her
Majesty's Most Honorable Privy Coun-
cil; Knight Grand Cross of the Most
Distinguished Order of Saint Michael and
Saint George; Governor and Commander-
in-Chief in and over Her Majesty's Colony
of New Zealand and its Dependencies,
and Vice-Admiral of the same; and issued
under the Seal of the said Colony, at the
Government House, at Wellington, this
twenty-third day of August, in the year
of our Lord one thousand eight hundred
and seventy-seven.

Proceedings of the Waipu South Highway District
Board validated.

ORDER IN COUNCIL.
At the Government House, at Wellington, this
twenty-first day of August, 1877.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS the Waipu South Highway District
in the Provincial District of Auckland, appointed one
Murdoch McLeod to be the valuer to make a valua-
tion list for such district, pursuant to "The Rating
Act, 1876," and he did accordingly make such list,
and signed and transmitted the same to the said
Board in accordance with the said Act : And whereas
the Judge of the Assessment Court of the district
appointed a sitting of the Court on the twenty-
seventh of March last for the purpose of hearing and
determining objections to such valuation list, and at
such sitting it appeared to the Court that the said
Board had omitted to comply with certain provisions
of the said Act with respect to such valuation list,
and the Court adjourned until the eighth day of May
to enable the said Board to comply with such provi-
sions: And whereas at such adjourned sitting it
appeared that the said Board had appointed one
Alexander P. Campbell to be the valuer of the Board,
and to prepare the valuation list required by the said
Act, in lieu of the said valuation list prepared by
the said Murdoch McLeod ; and that the said Alex-
ander P. Campbell had accordingly prepared such
valuation list, and that all things required by the
said Act to be done with respect thereto had been
done; and the said Court confirmed the appointment
of the said Alexander P. Campbell as valuer, and the
Judge of the said Court signed the valuation list pre-
pared by the said Alexander P. Campbell, as required
by the twenty-ninth section of the said Act: And
whereas it is expedient to validate anything irregu-
larly done in matter of form with respect to the
appointment of the said Alexander P. Campbell as a
valuer, and in the preparation and otherwise of the
said valuation list prepared by him:β
Now, therefore, I, George Augustus Constantine,
Marquis of Normanby, the Governor of the Colony
of New Zealand, with the advice and consent of the
Executive Council, and in exercise and pursuance
of the powers and authorities vested in me by
"The Rating Act, 1876," and all other powers
and authorities in that behalf me hereunto
enabling, do hereby order and declare that, not-
withstanding anything irregularly done in matter
of form by the said Board or by the Assessment
Court with respect to the appointment of the said
Alexander P. Campbell as a valuer, and the pre-
paration and otherwise of the valuation list afore-
said for the said district, such valuation list shall be
a good and valid valuation list for the said district,
and shall be the valuation roll for the Waipu South
Highway Board District, and shall remain in force
until a fresh roll is made in the next following year.
