Delegating Powers under Sections 30, 31, and 32 of
"The Marine Act, 1867," to New Plymouth
Harbour Board.

ORDER IN COUNCIL.
At the Government House, at Wellington, this
seventeenth day of April, 1877.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

BY virtue of all the power and authority in me
vested in that behalf by "The Abolition of
Provinces Act, 1875," "The Harbour Boards Act,
1870," and "The Marine Act, 1867," I, George
Augustus Constantine, Marquis of Normanby, Go-
vernor of the Colony of New Zealand, by and with
the advice and consent of the Executive Council of
the said colony, do hereby delegate unto the
NEW PLYMOUTH HARBOUR BOARD,

as the same is constituted by an Ordinance of the
Provincial Council of Taranaki intituled "The New
Plymouth Harbour Board Ordinance, 1875," all the
powers, duties, and authorities vested in me by
sections thirty, thirty-one, and thirty-two of "The
Marine Act, 1867:" Provided that this delegation
shall be limited to the Port of New Plymouth, as
the same is defined by warrant dated the twentieth day
of November, one thousand eight hundred and
sixty-eight, and published in the New Zealand Gazette
of the twenty-third day of November, in the same
year.

in a warrant bearing date the twentieth day of
November, one thousand eight hundred and sixty-
eight, and published in the New Zealand Gazette of the
twenty-third day of November, in the same year:
subject, however, to such restrictions as in the said
Schedule set forth.

And in further pursuance and exercise of the
hereinbefore in part recited power and authority,
and with the like advice and consent as aforesaid, I
do hereby delegate unto the said New Plymouth Har-
bour Board all the powers vested in the Governor in
Council by the tenth section of "The Marine Act,
1867:" Provided that the delegation lastly herein-
before contained shall be limited to the said Port of
New Plymouth.

SCHEDULE.

SUCH of the powers vested in the Governor by the
seventh section of "The Marine Act, 1867," as
enable him to erect, superintend, and maintain
harbour marks, buoys, lights, and beacons within the
limits of the Port of New Plymouth, or the approaches
thereto. Subject, however, to such directions as may
from time to time be issued by the Commissioner of
Customs as to the size, position, and colour of such
harbour marks, buoys, and beacons, and in the case
of lights, to the approval first obtained of the said
Commissioner of Customs; and subject also to the
condition that no notices to mariners shall be issued
by the New Plymouth Harbour Board until after such
notices have been approved of by the Marine Depart-
ment. Also such of the powers vested in the
Governor by the said seventh section as enable him
to appoint, suspend, or remove Port or Harbour
Masters, and other officers of the port or harbour:
Provided that this delegation shall be limited to the
Port of New Plymouth aforesaid.

10 of "Marine Act, 1867," to the New Plymouth
Harbour Board.

ORDER IN COUNCIL.
At the Government House, at Wellington, this
seventeenth day of April, 1877.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by the ninth section of "The Harbour
Boards Act, 1870," it is, among other things,
enacted that the Governor may, by Order in Council,
from time to time delegate to any Harbour Board
constituted thereunder all or any of the powers and
authorities vested in him by the provisions contained
in the seventh and tenth sections of "The Marine
Act, 1867," subject to any regulations, restrictions,
or stipulations that may be specified in such Order:
And whereas by an Ordinance of the Provincial
Council of Taranaki intituled "The New Plymouth
Harbour Board Ordinance, 1875," a Harbour Board
was constituted for the Port of New Plymouth :
And whereas it is expedient that certain powers
should be delegated to the New Plymouth Harbour
Board, as in manner hereinafter set forth :
Now, therefore, I, George Augustus Constantine,
Marquis of Normanby, the Governor of the Colony
of New Zealand, by and with the advice and consent
of the Executive Council of the said colony, in pur-
suance and exercise of the hereinbefore recited power
and authority enabling me in that behalf, do hereby
delegate unto the

aforesaid the several powers and authorities men-
tioned and set forth in the Schedule hereto annexed,
such powers and authorities to be exercised within

How Education Boards accounts to be kept and
audited.

ORDER IN COUNCIL.
At the Government House, at Wellington, this
seventeenth day of April, 1877.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by "The Education Boards Act
1876," it is enacted that every Board shall
keep accurate accounts of all costs, charges, expenses,
and disbursements in connection with the manage-
ment and administration of all lands vested in them,
and also of all sums of money received as rents
issues profits or proceeds of or from the said lands,
and shall cause such accounts to be made up as the
Governor in Council may order, and shall prepare a
balance sheet of the said accounts; and such accounts
and balance sheet, audited in such manner as the
Governor in Council may order, shall be forwarded
to the Minister along with the report of the Board
hereinafter mentioned.

Now, therefore, His Excellency the Governor, by
and with the advice and consent of the Executive
Council of the colony, doth hereby order that the
Education Boards constituted under "The Education
Boards Act, 1876," shall forthwith cause such ac-
counts to be made up to the thirty-first day of
March last; and such accounts and balance sheet as
aforesaid shall be audited by the persons whose names
