HIS Excellency the Governor has been pleased to
appoint

FITZHERBERT DERMOTT, Esq.,
to be a Member of the Local Cattle Board of the
District of Westland, vice Dr. Garland, resigned.

the Waste Lands Board or District Land Officer
appointed for that purpose may, subject to the
provisions of any Act regulating the gold fields,
and to the regulations that now or hereafter may be
in force relating to gold fields, authorize the holder
of a miner's right to construct and use water races
and sludge channels, dams, or reservoirs for mining
purposes, and may also authorize any person to
construct and use water races, dams, and reservoirs,
for the purpose of irrigation, manufactures, or other
industrial purposes, through or over Crown or private
lands, whether in a proclaimed gold field or not, and
to divert and use for such purposes any water which
Her Majesty may lawfully divert and use; and to
occupy for the purpose of depositing matter removed
from such water races, sludge channels, dams, or
reservoirs, the land immediately adjoining such water
races and sludge channels, dams, or reservoirs, as
therein mentioned: And whereas by the seventy-
first section of the said Act it is also enacted that it
shall be lawful for the Governor in Council from
time to time to make, alter, and revoke regulations
for imposing on the holders of licenses granted under
this or any preceding Act, or under any rules and
regulations that formerly have been, now are, or
hereafter may be in force, empowering such holders
to cut, construct, and use water races, sludge channels,
dams, and reservoirs, such periodical rents, fees, or
other payments, as he may think fit: Provided
always that no less rate than two shillings and six-
pence, nor more than twenty shillings per sluice-
head per annum, shall be imposed upon or demanded
on account of any water race lawfully held, occupied,
and used by virtue of a license at the date of the
passing of this Act: And whereas it is expedient
that regulations should be made imposing an annual
rent on the holders of licenses for water races as
hereinafter provided:

Now therefore, His Excellency Sir James Fergus-
son, Baronet, the Governor of the Colony of New
Zealand, in pursuance and exercise of the power and
authority vested in him by the said Act, and by and
with the advice and consent of the Executive Council
of the said Colony, doth hereby make the following
Regulations:-

REGULATIONS.

  1. From and after the making of these Regulations
    there shall be imposed on the holders of licenses for
    water races, as hereinafter mentioned, an annual rent
    of two shillings and sixpence for every sluice-head of
    water.

  2. These Regulations shall apply and extend to
    licenses for water races lawfully held, occupied, and
    used at the date of the passing of "The Otago Waste
    Lands Act, 1872," or which may have been issued
    subsequently thereto, and are now in force respect-
    ively; and shall also extend to such licenses as may
    hereafter be issued under the said Act.
