Rehearing Claim of Raika Whakarongotai and
Honana Te Ngangai.

ORDER IN COUNCIL.
At the Government House, at Wellington, this
seventh day of May, 1873.
Present:
HIS EXCELLENCY THE OFFICER ADMINISTERING
THE GOVERNMENT IN COUNCIL.

WHEREAS at a sitting of the Native Land
Court of New Zealand, at Shortland, in the
District of Hauraki, Province of Auckland, on the
fourth day of December, one thousand eight hundred
and seventy-two, the claim of Raika Whakarongotai
and Honana Te Ngangai, aboriginal natives of New
Zealand, residing at Hauraki, to a piece of land
called Te Ipuwhakatara, situate at Hauraki, in the
district aforesaid, was heard, and a certain order was
thereupon made by the Court aforesaid: And
whereas it is enacted by "The Native Lands Act,
1865," and "The Native Lands Act, 1867," and
"The Native Lands Act, 1870," that the Governor
in Council may order a rehearing of any matter
judicially heard before the Court aforesaid, and
before one or more Judges of the Court, and one or
more Assessors, as may be specified in the Order in
Council ordering such rehearing, and within such
period of time as may be limited in such order, pro-
vided that no such order for rehearing shall be made
after six months shall have elapsed from the date of
the original decision: And whereas it is expedient that
the said claim shall be reheard before the said Court:
Now, therefore, His Excellency the Officer Ad-
ministering the Government, with the advice and
consent of the Executive Council of the Colony, in
pursuance and exercise of the above-recited power
and authority, doth hereby order that the aforesaid
claim of Raika Whakarongotai and Honana Te
Ngangai to the aforesaid piece of land shall be re-
heard before one Judge of the said Court and one
Assessor thereof.

And doth order that such rehearing shall take
place before the thirtieth day of April next.

Purpose for which "Original Reserve," County of
Westland, was made, changed.

ORDER IN COUNCIL.
At the Government House, at Wellington, this
seventh day of May, 1873.
Present:
HIS EXCELLENCY THE ADMINISTRATOR OF THE
GOVERNMENT IN COUNCIL.

WHEREAS, pursuant to the Waste Land Regu-
lations then in force in the Province of
Canterbury, Samuel Bealey, Esquire, then being the
Superintendent of the said Province, by a notice
dated the fifteenth day of September, one thousand
eight hundred and sixty-five, published in the Govern-
ment Gazette of the said Province on the twenty-
first day of September in the same year, temporarily
made a reserve of a parcel of land at Hokitika, con-
taining fifty-seven acres, more or less (numbered
451 in red), for a public common : And whereas on
the first day of December, one thousand eight
hundred and sixty-five, the Provincial Council of
the said Province, by a resolution, confirmed and
adopted the making of the said reserve: And whereas
the said reserve is now subject to the provisions of
"The Westland Waste Lands Act, 1870," and by
the said Act it is among other things enacted that
reserves heretofore or thereafter to be made of
Waste Lands shall be managed and administered by
the Governor in Council: And it is also enacted
that the specified purposes for which any such
reserves shall be held may be changed, and any such
reserves may be leased, mortgaged, or sold, either in
whole or in part, by the Governor in Council, as
therein provided: And whereas it is expedient that
the purposes of such reserve should be changed, and
that the same should be otherwise dealt with as
herein mentioned :

Now, therefore, His Excellency Sir George Alfred
Arney, the Officer Administering the Government
of the Colony of New Zealand, in pursuance and
exercise of the power and authority vested in him by
the hereinbefore in part recited Act, and by and
with the advice and consent of the Executive Council
of the said Colony, doth hereby order that the
purpose for which the said reserve was originally
made (hereinafter called the " original reserve ")
shall be changed, to the intent that the parcel of
land described in the Schedule hereto shall, under
the provisions of the said Act, be made a reserve for
the purposes of a Public Cricket Ground, and that
the residue of such original reserve shall be sold as
hereinafter mentioned: Provided that before such
change shall take effect, the Waste Lands Board of
the County of Westland shall publish at least two
calendar months' notice thereof in the County of
Westland Gazette.

And in further pursuance and exercise of the
power and authority aforesaid, and by and with the
like advice and consent as aforesaid, it is ordered
that the residue of the said original reserve remain-
ing after the creation of the so intended reserve for
a public cricket ground shall be sold, and that the
time, place, and conditions of such sale shall be
fixed by the said Waste Lands Board, and shall be
published in the County of Westland Gazette at least
two calendar months before such sale shall take
place.

SCHEDULE.
ALL that parcel of land in the County of Westland,
containing twenty-six acres, more or less, situate
near the Town of Hokitika; bounded on the South
by the Hokitika River, and on the West, North, and
East by an overflow channel,--- for a Cricket Ground.
