Regulations under "Public Trust Office Act, 1872."

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this
twentieth day of December, 1872.

Present:

THE HONOURABLE THE PREMIER, PRESIDING, AND
MEMBERS OF THE EXECUTIVE COUNCIL.

WHEREAS by "The Public Trust Office Act,
1872," it is provided that the Governor may by
Order in Council make, and from time to time revoke
or alter, regulations for the conduct of the business
in the Public Trust Office, and for determining the
duties of the officers and servants employed therein,
and for the custody of the property placed therein,
and for fixing scales of charges upon such property,
for the cost of managing the same, and for the receipt
and payment of moneys belonging to or accruing
from such property, and for keeping, rendering, and
auditing accounts of such moneys, and for directing
in what bank the same shall be kept, and for deter-
mining what part of, and in what securities, such
moneys shall be invested, and for the safe custody of
such securities: Provided that no such regulation
shall be repugnant to any of the provisions of the
said Act; and also that all moneys being part of, or
accruing out of, property placed in the Office of
Public Trust, and all moneys received by the Public
Trustee or any other person on account of the said
office, shall be paid, on the same day on which the
same is received, into such bank as the Governor in
Council directs: Now, therefore, His Excellency
the Governor, in exercise and pursuance of all power
and authority enabling him in this behalf, and with
the advice and consent of the Executive Council of
New Zealand, doth hereby make the regulations and
directions set forth in the Schedule hereto.

SCHEDULE.

WHERE used in these Regulations, the terms following
shall have the meaning hereby attached to them :-

"The Act" means "The Public Trust Office
Act, 1872."

"The Board" means the Board mentioned in
the 18th section of the Act.

"The Office" means the Public Trust Office
within the meaning of the Act.

The Public Trustee" means the Public Trustee
for the time being appointed under the said
Act.

"Trust property" means any property as defined
by the Act placed in the Office.

REGULATIONS.

  1. The Office shall be at the Government Build-
    ings, Molesworth Street, Wellington.

  2. Such Office shall be kept open from the hours
    of 10 a.m. to 4 p.m. daily, except Sundays and Satur-
    days, and on Saturdays from 10 a.m. to 2 p.m.

  3. As to the mode of keeping the accounts of the
    Office and the conduct of the business of the Office,
    the Public Trustee shall (except so far as the matter
    is regulated by the Act) comply with such directions
    as he shall receive from the Board.

  4. The Board shall meet for the despatch of busi-
    ness on Tuesday in each week, at 11 o'clock a.m., at
    the Office, and at such other days and times as the
    Board shall be called together by the Public Trustee.

  5. The Board may from time to time make such
    rules as it may think fit for the conduct of business
    by the Board, and for appointing the person to preside
    at its meeting.

  6. The Seal of the Office referred to in the Act
    shall be circular, of the diameter of two inches,
    having the Royal Arms in the centre, and around the
    same the words "Public Trust Office, New Zealand,"
    in Roman letters of one-eighth of an inch in length.

  7. When any person, company, or other body
    desires that the execution of any trust created or to
    be created by deed or will shall be undertaken by
    the Public Trustee, such person, company, or other
    body shall make application to the Public Trustee in
    the form provided by the Office. The particulars of
    the proposed trust must be transmitted with the
    application, and the applicant may at the same time
    transmit the several deeds or documents relating to
    the trust property. No trust can be accepted in
    which any other person is joined with the Public
    Trustee. Forms of application, to be approved of by
    the Board, shall be provided by the Public Trustee
    and be obtainable at the Public Trust Office, or at
    any Money Order Office within the Colony.

  8. When any will is received for safe custody it
    shall be distinguished by a number and recorded in
    the books of the Office, and during the life of the
    testator such will shall be deliverable up to him only,
    or to an agent who, to the satisfaction of the Public
    Trustee, is duly authorized to receive it. After the
    death of the testator the will shall be delivered up
    to the person named therein as executor or executrix,
    unless the same be indorsed as delivered for accept-
    ance or rejection in accordance with section 20 of
    the said Act.

  9. The Public Trustee, under direction of the
    Board, may employ such local agents as may be
    required for the management of the several estates
    placed in the Public Trust Office.

  10. A list of all deeds or other instruments relating
    to property placed in the Public Trust Office, and of
    all securities on which any moneys, being portions or
    the produce of such property, shall be entered in a
    book to be kept in the Office of the Public Trustee
    for the purpose, and such list shall be compared with
    the instruments and securities described therein by
    the Commissioners of Audit once in each quarter of
    a year, on a day to be fixed by the Commissioners of
    Audit, and at such other times as the Commissioners
    of Audit may think fit.

  11. The bank in which the Public Account is kept
    shall be the bank in which "The Public Trustee's
    Account" shall be kept.

  12. All deeds, wills, securities, and other documents
    connected with property placed in the Public Trust
    Office shall be kept in a fireproof safe in the Public
    Trust Office, which safe shall be secured by three
    locks, the keys of such locks to be held-one by
    the Colonial Treasurer, or Minister acting for the
    Colonial Treasurer, one by the Commissioners of
    Audit, and one by the Public Trustee.

  13. All moneys received by local agents on account
    of properties placed in the Public Trust Office shall
    be paid to the nearest branch of the bank, to the
