shall on conviction be liable to a penalty not exceeding £5.

44. All penalties recoverable under this By-law shall be recovered in a summary way before two Justices of the Peace or a Resident Magistrate in the manner provided by the said Acts.

45. This By-law shall apply to all hackney carriages and borough stage carriages within the meaning of the clause next hereinafter contained which shall be used in standing or plying for hire within the circumference of a circle whose radius shall be of a length not exceeding ten miles measured from the principal Post-office of the City of Christchurch.

46. In this By-law the word “carriage” shall include both a “hackney carriage” and a “borough stage carriage.” And the term “hackney carriage” shall include every wheeled carriage whatever may be its form or construction used in standing or plying for hire for a passenger in any street within the said circle not being a stage carriage and not being such borough stage carriage as next hereinafter mentioned. And the term “borough stage carriage” shall include every wheeled carriage whatever may be its form or construction used in standing or plying for hire for passengers at separate fares and which shall upon every journey go from or come to any place within the said circle to or from any other place within the said circle. And for purposes hereof any “hackney carriage” or “borough stage carriage” (as the case may require) shall be deemed sufficient to describe a carriage of either of the kinds hereinbefore mentioned. And the word “owner” shall include every person who either alone or in partnership with any other person shall keep or be concerned otherwise than as a driver or attendant in the keeping, employing or letting to hire of any hackney carriage or borough stage carriage. And the word “conductor” shall include every director or other person except the driver who shall attend upon the passengers in any borough stage carriage. And the word “passenger” shall include every person carried by any hackney carriage or borough stage carriage except one driver and (where there shall be a conductor to such borough stage carriage) one conductor.

47. The By-laws or parts of By-laws heretofore specified being all the By-laws or regulations heretofore in force in and for the said City of Christchurch which are inconsistent with or repugnant to the provisions hereof or in any respect deal or purport to deal with the subject matter of this By-law are hereby repealed namely two By-laws made by the Council on the 9th day of August 1869 and intituled respectively “By-law No. 2 Hackney Carriages and Borough Stage Carriages” and “By-law No. 3 Hackney Carriages and Borough Stage Carriages,” and a By-law made by the Council on the 29th day of December 1873 and intituled “By-law No. 14 Hackney Carriages and Borough Stage Carriages.”
