(8.) Any hired driver may wait for his hirer at any convenient place which may be appointed by such hirer at the side of any street.

  1. No driver of any hackney carriage plying for hire or waiting upon any public stand shall unless then actually hired by some other person or without other reasonable cause refuse or neglect to take immediately any fare not exceeding the number of persons which such carriage is licensed to carry nor shall any such driver refuse or neglect to carry any reasonable quantity of luggage for any person hiring or desiring to hire such carriage nor shall he without reasonable cause refuse or neglect to drive to any place within the limits prescribed by this By-law nor shall he unless required by such hirer drive at a slower speed than six miles an hour.

  2. No owner or driver of any hackney carriage shall exact or demand for the hire thereof to any place within the limits hereinafter prescribed any greater sum than may be properly chargeable under clause 24 And in the event of any such overcharge being paid the Justices or Resident Magistrate by whom any charge under this section may be adjudicated may in addition to imposing the penalty hereinafter provided order the owner or driver exacting such overcharge to pay the amount thereof to the party aggrieved.

  3. No owner or driver of any hackney carriage having agreed to take any fare at any time to or from any place within the limits hereinafter prescribed shall refuse neglect or delay to fulfil such agreement.

  4. The driver of any hired hackney carriage shall not allow any person to ride on the box or in or upon any part of such carriage without the express previous permission of the person hiring the same.

Borough Stage Carriages.

  1. The owner of every borough stage carriage shall at the time of obtaining his licence from the Town Clerk procure to be endorsed on such licence the places or termini between which and the route along which such carriage is to ply and shall not permit to stand or ply for hire such carriage between any other termini or along any other route without advertising such change at least 24 hours previously in two newspapers circulating in Christchurch and if such change be for a limited period the time during which the same is to continue.

  2. No driver or conductor of a borough stage carriage shall allow any person to smoke inside any such carriage or knowingly carry in such carriage any person who violently noisily or indecently conducts himself or otherwise so misbehaves himself as to annoy any other passenger save for such time only as to remove such person from the carriage or to procure his delivery into proper custody.

  3. No driver or conductor of any borough stage carriage for the time being employed or plying as such shall carry any greater number of passengers at one and the same time than such carriage is licensed to carry or shall refuse or neglect to carry any passenger not forming with other passengers already being in such carriage an excess over the number which such carriage is licensed to carry and to whose admission no reasonable objection is made.

  4. No passenger shall smoke inside any borough stage carriage or violently noisily or indecently conduct himself or otherwise so misbehave as to annoy any other person therein or thereon.

  5. Until and subject to amendment and alteration as the Council may at any time hereafter from time to time see fit the fare chargeable for the conveyance of passengers in Borough Stage Carriages shall be as set forth in Schedule F to this By-law.

Hackney Carriages and Borough Stage Carriages.

  1. Any person refusing or neglecting to give up to the conductor of any carriage or if there be no conductor to the driver thereof any property left therein shall be liable to a penalty not exceeding Β£20.

  2. Any conductor or driver of any carriage to whom any property left therein shall be given. And any conductor or driver of any carriage who shall find any property left in any carriage shall within two days thereafter carry such property in the state in which the same shall have come to his hands to the office of the Town Clerk and deposit the same with him. And every conductor or driver offending against this clause shall forfeit a sum not exceeding Β£20.

  3. The Town Clerk shall forthwith enter in a book to be kept by him at the said office for the purpose the description of such property and the name and address of the conductor or driver who shall have deposited the same and the day on which it shall have been deposited and shall advertise the same in such manner as the Council shall direct. And if any person shall within one year after the same shall have been so deposited claim the said property and establish his title thereto to the satisfaction of the Council and shall pay to the Town Clerk all expenses incurred in relation thereto together with such reasonable sum as the driver or conductor depositing the same as the Council having regard to the value of the property shall award the Town Clerk shall return to such person the property so deposited. And in default of any such claim and establishment of title thereto shall if the conductor or driver depositing such property shall apply for the same within one month after the expiration of the said one year and shall pay to the Town Clerk all expenses incurred in relation thereto deliver the same up to such conductor or driver. And in default of such application the Council shall order such property to be sold and the proceeds thereof shall be carried to the Borough Fund.

  4. Every person offending against any provision of this By-law other than the provisions contained in clauses 40 and 41 hereof
