BYE-LAW (No. 4).

BYE-LAW. FOR REGULATING PUBLIC LODGING HOUSES.

BYE-LAW of the Council of the Borough of Auckland; made under Special Order of the said Council; dated the 14th day of August, 1871; confirmed the 11th day of September, 1871; and sealed with the Common Seal of the Council of the said Borough the 13th day of September, 1871.

In pursuance of Section 186 of "The Municipal Corporations Act, 1867," the Council of the Borough of Auckland ordain as follows, that is to say:—

  1. It shall not be lawful to keep or use, as a Public Lodging House within the limits of the Borough, any house unless the same shall have been registered as a Lodging House in a book to be kept by the Town Clerk for that purpose.

  2. Every House shall be deemed a Public Lodging House within the meaning of this Bye-law, in which persons are harboured or lodged for hire for a single night, or for less than a week at one time, or any part of which is let for less than one week. Provided always that the provisions of this Bye-law shall not affect any house or premises duly licensed as a Public House Tavern or Hotel.

  3. The Town Clerk shall keep a Register in which shall be entered the names of all persons applying to have the houses occupied by them registered as Lodging-houses, and the situation of such houses, and the number of lodgers who may be received into each Lodging-house at one time.

  4. Every person applying for such license shall pay therefor a fee of One Pound (£1), and such license shall be in force for one year from the date of its issue.

  5. A ticket stating the number of lodgers allowed to be received into any such licensed Lodging House at one time shall be hung up or placed in a conspicuous part of each room, into which lodgers are received.

  6. The Keepers of all such Lodging Houses shall at all times observe these Rules and allow access to such Lodging Houses when required by the police, the Inspector of Nuisances or any other person appointed by the Council for the purposes of inspection thereof or otherwise.

  7. Every Keeper of any such Lodging House who shall neglect to observe these rules, or who shall refuse to admit to such Lodging House at all reasonable times the police, Inspector of Nuisances, or any other person appointed by the Council, or shall wilfully obstruct the police, Inspector of Nuisances, or any other person or persons appointed as aforesaid in the performance of their duty, shall on conviction forfeit a sum not exceeding Five Pounds (£5) for each offence.

  8. Every person who shall keep any Public Lodging House and receive any Lodgers therein without such Lodging House having been duly registered, shall be liable to a penalty not exceeding Five Pounds (£5).

  9. Every keeper of any licensed Lodging House who shall receive into the same at one time more lodgers than shall have been allowed by the Council, or who shall fail to keep such ticket as aforesaid hung up or displayed as required shall be liable to a penalty not exceeding Five Pounds (£5) for each offence.

  10. The Council of the said Borough may from time to time make regulations for promoting cleanliness and ventilation in such Lodging Houses.

BYE-LAW (No. 3.)

BYE-LAW—TO REMOVE OBSTRUCTIONS IN PUBLIC THOROUGHFARES, &c.

By-Law of the Council of the Borough of Auckland, made under Special Order of the said Council, dated the 14th day of August, 1871; confirmed the 11th day of September, 1871; and sealed with the Common Seal of the Council of the said Borough the 13th day of September, 1871.

In pursuance of Section 186 of "The Municipal Corporations Act, 1867," the Council of the Borough of Auckland ordain as follows, that is to say:—

Any person or persons who shall by loitering, standing, or in any other manner whatsoever obstruct or encumber any public place, thoroughfare, pavement, or footpath within the Borough of Auckland to the inconvenience, annoyance, detriment or danger of passengers or persons after having been requested by a constable or police-officer to move on, and to cease such loitering, standing, obstruction or encumbrance, shall for every such offence forfeit and pay a sum not exceeding Five Pounds.

  1. The Council of the said Borough may at any time give, or cause to be given, notice in the manner prescribed in Section 371 of "The Municipal Corporations Act, 1867," to all owners of freehold property in Queen-street aforesaid within the said limits to pave the footpath in front of their respective properties; and such notice shall state the manner in which the work shall be done, the kind of stone to be used, and the time to be allowed for the completion of the work. Provided that all owners of leasehold property in the said street within the limits aforesaid, whose leases shall, at the time of the notice being given, have seven years to run, shall be liable to pay one half the expense of paving, and the owner of the freehold the other half.

  2. Any Owner or Leaseholder of such property within the limits aforesaid who shall fail to comply with the terms of the said notice shall be liable to a penalty not exceeding Five Pounds.

  3. In case of such Owner or Leaseholder failing or neglecting to carry into effect the provisions of this Bye-law when required so to do by notice as aforesaid, it shall be lawful for the Council of the said Borough to cause such work to be done, and the expense thereof shall be repaid to the Council by the Owner or Leaseholder as aforesaid, by whom such work ought to have been done respectively, and shall be recoverable under Sections 373 and 374 of "The Municipal Corporations Act, 1867."

  4. The Council of the said Borough may, in their discretion, pay for and find the labour necessary for laying down such pavement as aforesaid.
