THE PROTECTION OF GARDENS ACT, 1868.

THE following Act, made and passed by the Superintendent and the Provincial Council, is published for general information.

An Act for the Protection of Gardens.

BE IT ENACTED by the Superintendent of the Province of Auckland, with the advice and consent of the Provincial Council thereof, as follows:

  1. The Short Title of this Act shall be “The Protection of Gardens Act, 1868.”

  2. The word “garden” for all the purposes of this Act shall mean and include any garden or orchard and any plantation or ornamental ground; and the word “animal” shall mean and include goats pigs and all sorts of domestic fowls.

  3. It shall be lawful for the owner lessee or occupier of any garden or his agent or servant to destroy any animal which shall trespass upon or enter into such garden. Provided that the same be fenced according to the fencing laws at the time in force.

  4. This Act shall not prejudice or interfere with the right of such owner lessee or occupier to sue for and recover damages for any injury committed by any animal destroyed as aforesaid in the same manner and as fully as he might have done if this Act had not been passed.

PUBLIC NOTIFICATION.

TENDERS will be received at this Office until noon of Saturday, the 25th instant, for the supply of the undermentioned articles, during the months of May and June:—

Bread for the Provincial Hospital.
Rations for the Lock-up.

PUBLIC NOTIFICATION.

Superintendent of the Province of Auckland.

BY virtue of the powers in me vested by the third section of “The Highways Act, 1867,” I do hereby notify that that portion of the Province of Auckland comprised within the boundaries hereunder described shall be a District under the said Act, and that such District shall be known by the name thereto prefixed, that is to say—

THE TOWN OF RAGLAN DISTRICT.

Bounded on the north-west by the Whaingaroa harbour; on the north-east by Whaingaroa harbour aforesaid and the road which forms the north-eastern boundary of sections Nos. 6, 7, and 12, of the Town of Raglan; on the south by the seaward boundary of the road bounding sections Nos. 12, 13, 14, 15, and 19, of the Town aforesaid; and on the west by the Opoturu creek.

Given under my hand, at Auckland, this fourteenth day of April, one thousand eight hundred and sixty-eight.
