imposing and collecting such rates, and for
disbursing the same for the purposes aforesaid:

For securing the baling of water from
mines, so as to prevent injury from such
water to any mining workings:

And whereas, the Mining Drainage Board
of the District of Jones’s Flat have hereto-
fore made certain bye laws for regulating
the drainage of certain portions of the said
district, and imposing equal weekly rates
upon the owners thereof and it is advisable
to withdraw and exempt the claims and
claimholders whose names are set forth in the
schedule hereto annexed from the operation
of some of such bye laws, and to substitute
a contribution rate upon them in lieu thereof:

Be it therefore ordained by the said Mining
Drainage Board of the District of Jones’s
Flat, that from and after the coming into
operation of this bye law, the claims and
claimholders set forth in the schedule to this
bye law shall be withdrawn and exempted
from the operation of Clauses 5, 7, and 8 of
Bye Law No. 2, and from the operation of
Bye Laws numbered respectively 4, 8, 11,
14, 18, 19, 20, 21, 23 and 24: Provided
always that any rates lawfully recoverable
under any of the said bye laws before the
coming into operation of this bye law may
be levied, sued for, and recovered in like
manner, and as effectually as if this bye law
had not been made:

Be it also ordained that from and after the
coming into operation of this bye law the
contribution to be paid by the undermentioned
claimholders shall be the amount set
opposite to their respective names in the
Schedule hereunto annexed, that such amount
shall be payable weekly on each and every
Friday to the Clerk of the said Mining
Drainage Board of the said District of Jones’s
Flat; such amounts shall be applied for the
purposes mentioned in Section 12,
Sub-Sections 3, 4, and 5 of “The Gold Mining
Claims Drainage Act, 1868,” and shall be
payable by the owners, for the time being,
of the said claims:

That the term owner shall include a mort-
gagee in possession:

That the amount of the said contributions
shall continue to be paid by the said owners
during the continuance of this bye-law, not-
withstanding any of such owners shall have
abandoned any portion of his claim, or shall
have taken up under the Gold Fields Regula-
tions, any additional ground adjoining his
claim:

Provided that in case any of the said
claimholders, or owners, mentioned in the
said Schedule, shall altogether abandon his
claim, it shall not be necessary to enact a new
bye law; but the amount of the contribution
payable by the claimholder, or owner, so
abandoning his claim as aforesaid, shall be
divided amongst, and paid by, the remaining
claimholders and owners rateably on the
amount of their respective contributions:

Provided always that the amount of such
contributions shall not be thereby increased
more than one-fourth:

That the total amount of the said contri-
butions named in the said Schedule, viz.,
£157 10s. shall be applied for as follows:
£144 7s. 6d., for the purposes of Section 12,
Sub-Section 3; and £13 2s. 6d. for the
purposes of Section 12, Sub-Sections 4 and 5.
