close to the stack: Provided also that if any person shall wish to mine upon such ground during the period of protection, he shall do so on paying to the owner of the stack the expenses of removal to such site as may be approved of by the Warden. Such registration may be renewed at the expiration of the time for which the protection has been granted. This regulation to apply to auriferous quartz or quartz tailings, in which case the protection shall extend to twelve (12) months.
- Ownership of Trees upon Claims.
All trees situated upon any claim taken up for mining purposes shall be the property of the owners thereof during the time they are in legal possession of the claim on which such trees are situated.
- Ground to be Secured.
If any person shall find that the party working the adjoining claims are not properly securing their ground, he shall make application to the Warden, who may make such order relative to such securing of the ground as he may deem necessary.
- Removal of Slabs.
No person shall remove slabs, props, or timber cut of any abandoned shaft, the removal of which may endanger the working of any other claim, or the security of any road, business site, residence area, or dwelling, or where any existing interest may be interfered with, without filling up or securing such ground or such shaft as the slabs are removed.
- Walls in Claims.
When a wall is required to be built for the security of ground in working claims, the Warden may decide who is to pay the expenses of making such wall, unless a mutual arrangement is entered into between the parties.
- Warning in Case of Blasting.
Ten minutes previous to the discharge of any blast of gunpowder or other explosive substance, within fifty (50) feet from the surface of the ground, due notice of such discharge shall be given by the persons who shall have prepared or caused such explosion to all other persons working, residing, or passing within a distance of one hundred (100) yards from the place of such discharge.
- Ventilation.
When cross drives or openings are required for ventilation in underground work of any description, and the various parties concerned cannot agree thereon, the Warden may issue an order for making such drives or openings, and for the allocation of the work to be performed, and also for the distribution of any auriferous deposits which may be found in the intervening wall.
- Use of Water in Creek or River Bed.
Any holder of a river claim may use the water in any water-course on any portion of his claim; provided he does not interfere with the water before it reaches his claim, and turns the water into its natural course immediately on its leaving his claim, and the holder of such claim shall have an equal right to use the water on any part of his claim, subject to the restrictions aforesaid, as though he used the water in the bed of the water-course.
- Water for Domestic Purposes.
Where any miner or miners, or holders of business licenses, find it necessary to reserve a water-hole for domestic purposes, the same shall be protected from damage: Provided that such water-hole shall not exceed in quantity of water, or extent of area of ground what shall be absolutely necessary for the domestic purposes of the applicant or applicants, who shall not be allowed to sell any water so protected, and that in cases of long continued drought or scarcity of water, the water-hole so protected shall become public property for domestic purposes only; and this clause further provides that any person or persons wishing to protect a water-hole for the above purpose, must cause a notice to that effect to be placed on a post alongside of such hole; and no person shall drive cattle into, or in any way defile water reserved for domestic purposes, or cart away the water from any dam without the consent of the owner or owners thereof.
- Water Privilege in Amalgamated River and Ordinary Claims.
Where a river claim is united to one or more claims of any other class, the water privileges of such river shall not extend further than if such river claim had not been united or amalgamated to any other.
- Right of Water and Roadway.
Every person holding a claim under these regulations shall be entitled to a supply of water for his use in connection therewith, and to a roadway whereby he may at all times obtain free ingress and egress thereto and therefrom.
- Protection to Roads.
Any person intending to construct a road, may on application to the Warden be granted protection for the same for one (1) year, at the expiration of which time the Warden may, if he deem it necessary, renew such protection for another year; but no protection shall be granted to any person for a period exceeding two (2) years.
