for the purpose of measuring the depth of any
shaft, or the dip, direction, inclination, or
length of any tunnel or drive.

NOTICE TO CONTAIN FULL PARTICULARS.
All notices tendered or posted in conformity with these regulations, must contain
the name in full of each member of the party,
together with the date and number of his
miner’s right. -
NOTICES TO BE POSTED AT THE WARDEN’S
OFFICE.
Copies of all notices given in conformity
with these regulations must be posted by the
Warden at his office, and exhibited on the
outside thereof during the currency of such
notice. -
WARDEN TO BE JUDGE OF OBJECTIONS.
The Warden shall in all cases be the sole
judge of the validity of objections to the issue
of any certificate of registration, and also of
what is a “reasonable time” for the performance of any work when no fixed period
is provided by these regulations. -
CERTIFICATE TO BE CANCELLED.
If any certificate shall have been obtained
by misrepresentation, or if any of the prescribed conditions have not been duly com-
plied with, the Warden may, upon proof
thereof, cancel such certificate, or make such
other order therein as may appear to be just
and equitable. -
PLURALITY OF SHARES.
Any miner by virtue of his miner’s right
may hold one or more shares in any claim or
claims, provided that every such share shall
be fully represented by a substitute who is
the holder of a miner’s right in accordance
with these regulations. -
REGISTRATION OF SHARES AND TRANSFERS.
Upon receipt of a certificate from the owner
or owners of a claim, or from the manager of
a company holding a claim, stating that said
owner or owners, or company have agreed to
give the person or persons named in such
certificate one or more sleeping or working
shares, as the case may be, in such claims,
and also stating the terms and conditions
upon which such shares are given, the
Warden shall thereupon register such person
or persons for such shares, and shall record
upon such register the terms and conditions aforesaid, and all such shares shall be held,
and shall only be transferred, assigned, or
otherwise disposed of, subject to the conditions under which such shares are registered. -
TRANSFERS, &c.
Any claim, right, privilege, share, or
interest therein held under these regulations
may be transferred or assigned; but where it
is provided that any such claim, right, or
privilege, share, or interest therein must
originally be registered, the transfer or assign-
ment thereof must also be registered. -
ABANDONMENT OF CLAIMS, TITLES, &c.
All registered rights, titles, &c., shall become forfeited if abandoned for the space of
one calendar month, unless in case of sickness
or unavoidable absence; but it shall be lawful
for the Warden in his discretion, upon sufficient cause being shown, to suspend the
operation of this regulation for a further
period of one month, and a certificate of such suspension shall be given in writing to the
occupiers, and a copy thereof shall be posted
for information outside the Warden’s Court. -
CLAIMS PROTECTED DURING THE OPERATION
OF AN INJUNCTION.
Whenever any injunction, issued by any
Warden, or other officer empowered to do so,
shall prohibit any party or parties from working any claim held under these regulations,
and such party or parties, in obedience to such
injunction, shall be absent from such claim, it
is hereby ordained that until such injunction
shall be dissolved, or expire by effluxion of
time, no person, by virtue of a miner’s right
or business license, shall trespass upon, occupy,
or interfere with such claim or any portion
thereof. -
CHATTEL INTEREST.
Any right, title, or interest, acquired or
created under the provisions of “The Gold
Fields Act, 1866,” or any preceding Act,
relating to the occupation of lands within
goldfields, or under any rules and regulations
made in conformity therewith, shall be deemed
and taken in law to be a chattel interest, and
may be inherited, assigned, transferred, seized,
and sold under any writ of fieri facias or
other writ of execution or warrant. -
AGREEMENTS TO BE BINDING.
Whatever mutual agreements and engagements may be entered into by the shareholders
of any claim for the proper working thereof,
shall be binding upon any one taking possession of a forfeited or abandoned share or
interest in such claim. -
STACKING AURIFEROUS SUBSTANCES.
Any person wishing to retain possession of
alluvial auriferous substances, shall make
application to the Warden, and if no objections
are lodged thereagainst, a certificate of protection may be granted for a period not
exceeding three (3) months: Provided that
such substance is properly stacked on ground
not supposed to be adapted for mining purposes, and that a board with the owner’s
name, address, and date of stacking legibly
written or painted thereon, be kept posted.
