such claim according to these regulations except as hereinafter provided in clauses 4, 5 and 6 of this section.
- QUARTZ IN CLAIMS IN ALLUVIAL GROUND.
Should a quartz reef be discovered in a claim in alluvial ground the owners of the claim may work such reef subject to all the provisions of these regulations.
- SUSPENSION ON THE WATER LEVEL.
The holders in any quartz claim who first strike water shall be entitled to receive from the Warden a certificate authorising suspension of work for three (3) months, but the holders of other claims on the same reef shall only be entitled to suspend work until the three (3) months granted to the first party have expired. Quartz claims being assessed for drainage, and unable to work on account of water, shall be allowed to suspend work on payment of drainage rates as imposed in the regulations, until sufficiently drained.
- SUSPENSION WHILST PROCURING MACHINERY.
Quartz claim holders shall be entitled to receive from the Warden a certificate authorising suspension of work whilst procuring machinery for such time as the Warden may deem necessary.
- QUARTZ CLAIMS DEPENDENT ON MACHINERY.
Should the machinery upon which any quartz claim is dependent for assistance be disabled or stopped from working, the holders of such claim shall be entitled to suspension from work for a reasonable time until the machinery is repaired or the working of it renewed. Holders of adjoining quartz claims who have worked out the level such machinery is drawing water from may suspend work for such reasonable time as the Warden may deem necessary.
- TUNNELS AND TRAMWAYS.
Any person cutting a tunnel or laying down a tramway for the greater convenience of working a quartz claim may hold possession of the same together with a wall of ten (10) feet on each side thereof: Provided the same does not impede the working of the claim of any other person or obstruct any road in ordinary use.
- SLUDGE.
Where machinery is employed an embankment for the purpose of retaining the sludge must be constructed, except the sludge can be more conveniently carried off by drainage without injury to any other person.
- FORFEITURE OF QUARTZ CLAIMS.
The obtaining from the Warden by false representation a certificate authorising suspension of work, under clauses 4, 5, 6, and 7; the non-compliance with clause 2 of this section; and the non-resumption of work after the expiration of the time allowed for suspension shall render the claim liable to forfeiture.
- REGISTRATIONS.
All interests in quartz claims must be registered; all mortgages, liens or encumbrances, and the sale of any shareholder’s interest under the decree, judgment, or order of any Court, or the decision of a Warden, must be registered. Fees for original registrations of quartz claims shall be five (5) shillings, and for all renewals or transfers, two (2) shillings and six (6) pence.
- WALLS TO BE LEFT.
A wall of six (6) feet shall be left between each quartz claim. Should any party neglect to leave a full wall, it shall be competent for the Warden to deduct the area necessary for such wall from his claim. Walls between quartz claims shall be the common property of the parties adjoining, and neither of them shall take down, mine into, remove, damage, endanger, or imperil any such wall, without first obtaining the consent in writing of the owners of the adjoining claims.
VII.—EXTENDED CLAIMS.
- EXTENSION OF CLAIMS.
Extended mining claims may be granted by the Warden upon application being made as hereinafter directed, subject to the conditions that a sufficient number of holders of miner’s rights shall be constantly employed thereon, as follows:—
For a quarter acre ... Two (2) men
For half an acre ... Four (4) men
For three quarters of an acre ... Six (6) men
For one acre ... Eight (8) men
For one acre and a quarter ... Ten (10) men
For one acre and a half ... Twelve (12) men
Provided that no such claim shall be granted in new and unworked ground, unless it be proved to the satisfaction of the Warden that such ground has been fairly tested and cannot profitably be worked in claims of the ordinary size; Provided also that an extended claim shall in no case exceed one and a half acres in extent, and may be of any form the Warden may sanction.
- FORM OF APPLICATION.
Application for extended claims shall be made to the Warden in the following form, and a sum of Five Pounds (£5) shall be deposited to cover the necessary expenses of survey. Any unexpended balance to be returned to the applicant. If the cost of survey exceed Five Pounds (£5), the additional cost shall be paid by the applicant.
