exceed seven hundred and twenty (720) feet in length.
(E) Extended claims shall not exceed a quarter of an acre for two holders of miner’s rights; no extended claim shall exceed one acre and a half in the whole.
(F) Any holder or holders of a miner’s right may occupy any spare ground between two or more claims, and such spare ground may be of any form. Provided that it shall not exceed in area a greater number of superficial feet than is allowed by these regulations.
- SCRUB’S GROUND TO BE FORFEITED.
If any person shall occupy a larger area of ground than that to which he is entitled under these regulations, he shall forfeit the surplus, and the claim shall be re-marked from any two pegs at the option of the Warden: Provided that if any shaft, face, or works shall come within the area of the ground so marked out, the party claiming the ground shall pay compensation to the original holder.
- LEAVE PENDING FORBIDDEN.
No person shall be deemed to possess a valid title to any claim unless the same shall be fairly worked during the entire period of occupancy, and any claim unworked beyond the space of one clear day shall be deemed to be forfeited, unless sufficient reason, such as sickness or other urgent cause, shall be proved to the satisfaction of the Warden.
- ABSENCE FROM CLAIMS.
In ordinary, river, spur, quartz, and extended claims any shareholder—except in cases specially provided for in these regulations—absenting himself from his work for forty-eight (48) hours, his share or interest is liable to be forfeited, unless he provide a competent miner as his representative.
- WAGES MAY BE PUT ON.
In all cases of absence of a shareholder, his partner or partners can, if he or they think proper, have his place supplied by a competent miner, and such absent shareholder shall be responsible for any reasonable wages due to the person so employed.
- RIGHT OF SERVANT VESTED IN EMPLOYER.
If any person being the holder of a miner’s right shall hire himself for wages to an employer, the right to hold and occupy any claim by virtue of such miner’s right, and to any gold therein, shall be vested in such employer: Provided always that in the event of non-payment of such wages, any person so employed shall be deemed to have a lien upon the claim whereon he has been employed to the extent of the amount of wages due to him.
- CLAIMS NOT TO BE FORFEITED BY NEGLECT OR HIRED WORKMEN.
No claim, right, or privilege shall be deemed to be forfeited through the neglect or absence of any hired servant thereon: Provided that if such neglect or absence be continued after seven days’ notice in writing of such neglect or absence shall have been given to the owner or holder thereof, or to his agent (by delivering the same to such owner, holder, or agent, either personally or by leaving the same at his abode, or last known place of residence), any such claim, right or privilege shall be deemed to be absolutely relinquished and abandoned.
IV. RIVER CLAIMS.
- NOTICE OF DIVERSION TO BE GIVEN.
Any person desirous of diverting the course of a permanent stream for working the bed thereof as a river claim shall first give notice of his intention to the Warden, and to all parties working in or occupying claims adjoining the proposed line of diversion; such notices shall be in the form set forth in Schedule A, and copies thereof shall be posted and maintained for a period of ten clear days at the points proposed for the commencement and termination of such diversion as aforesaid, and if no valid objection be entered thereagainst within the aforesaid period, the Warden may issue a certificate of registration to the applicant.
V. SPUR CLAIMS.
- WALLS TO BE LEFT.
A wall of twelve (12) feet shall be left between spur claims. Should any party neglect to leave a wall to the extent of six (6) feet on each side of his claim, it shall be competent for the Warden to deduct the area necessary for such wall from his claim.
- AREAS IMPEDED BY FRONTAGE CLAIMS.
Whenever auriferous spurs, terraces, or hills are under work, and the whole area is not taken up by frontage claims under these regulations, the same may be worked by miners, and are to be approached if required through the twelve (12) feet walls set apart by the preceding section, subject to these regulations.
VI. QUARTZ CLAIMS.
- QUARTZ CLAIMS TO BE NUMBERED.
All quartz claims shall be numbered consecutively on either side from the prospecting claim; the claim adjoining the prospecting claim shall be number one.
- QUARTZ CLAIMS TO BE FAIRLY WORKED.
Not more than fourteen (14) days after the claim has been taken possession of, work must be commenced and continued thereon by the number of men required to represent
