PROCLAMATION.

[Extracted from the New Zealand Gazette No. 28, of the 3rd June, 1870.]

WHEREAS by the 13th Section of "The Gold Fields Act, 1866," it is enacted that it shall be lawful for the Governor to authorise the construction, by private enterprise, of any Road, Bridge, Wharf, Ferry, or other public work, for the use and benefit of the public, and to permit the occupation, for a limited period, of sites for the same, and to provide for the payment of such tolls for a limited period by all persons using the same as he shall deem reasonable:

And whereas, by the one hundred and ninth Section of the said Act, it is enacted that it shall be lawful for the Governor in Council under his hand and the Public Seal of the Colony, from time to time to delegate to such person as the Governor may think fit all or any of the powers vested in the Governor by the said Act, except the powers conferred by sections twenty-two, forty, forty-eight, sixty, ninety-six, and one hundred and seven thereof, subject or not to any limitations or restrictions as he may think fit:

And whereas by an instrument in writing, dated the third day of February, 1869, and published in the New Zealand Gazette of the eighth day of February, 1869, His Excellency the Governor did, under his hand and the Public Seal of the Colony, delegate unto me, Conrad Hoos, Chairman of the County Council of the County of Westland, all the powers vested in the Governor under or by virtue of the "The Gold Fields Act, 1866," except the powers conferred by sections eleven, twenty-two, thirty, thirty-three, thirty-nine, forty, forty-eight, sixty, ninety-six, and one hundred and seven of the said Act, to have, hold, and exercise the said powers hereby delegated to me within the County of Westland:

Now therefore, I, Conrad Hoos, Chairman of the County Council of the County of Westland, in exercise of the powers in that behalf delegated to me, do hereby grant unto Card Brothers protection for six months for a track following New River Valley from mouth of Cockabulla creek to mouth of Maori creek at AM line (a distance of about five and a half miles) and I do hereby authorise the collection of the undermentioned tolls. The track to be maintained to the satisfaction of the County Engineer, and the protection to date from 1st July, 1870.

Given under my hand, at Hokitika, this eighteenth day of June, one thousand eight hundred and seventy.

PROCLAMATION.

WHEREAS, by Proclamation made by the Governor in Council on the 17th day of November, 1869, certain regulations for the sale, letting, occupation, and management of the Waste Lands of the Crown in the County of Westland were made and proclaimed and by the said regulations it was among other things provided that the sites of towns shall from time to time be determined by the Governor in manner therein mentioned, and that all sites for towns determined to be such sites before the coming into operation of the said regulations, shall continue to be sites for towns as if determined thereunder; provided always that upon the recommendation of the County Council, approved by the Waste Lands Board, the Governor may withdraw any such lands as sites for towns: And whereas the pieces of land mentioned in the Schedule hereto were determined to be sites for towns before the coming into operation of the said Regulations: And whereas the County Council of Westland, by a Resolution dated the 20th day of January, recommended the withdrawal of the said lands from being sites for towns, and the said recommendation was approved by the Waste Lands Board of the said County, and it is expedient that the said lands should be withdrawn from being sites for towns:

Now, therefore, I, Sir George Ferguson Bowen, the Governor of New Zealand, do hereby proclaim and declare that I withdraw the several pieces of land described in the Schedule hereto annexed from being sites for towns.


SCHEDULE.

Town of Hokitika South.

272 (in red), six hundred and forty acres more or less, having one mile frontage to the sea, and one mile frontage to the south Bank of the Hokitika, situate on the West Coast, for a township.

Town of Hohonu.

All that piece or parcel of land, containing 1000 acres, more or less, situate at the confluence of the Hohonu with the Teremakau, having a frontage of forty chains on the latter river, and extending north-easterly on either side of the Hohonu a distance of fifty chains, in a rectangular block.

Town of Morton.

All that piece or parcel of land, containing 200 acres, more or less situate at the confluence.
