shall leave upon the said road any horse, cattle, or carriage whatsoever, by reason whereof the payment of any tolls shall be avoided or lessened, or shall take off or cause to be taken off any horse or other beast or cattle from any carriage, either before or after having passed through or by any toll-bar, toll-gate, or toll-house, or on or over any ferry, or having passed through, by, or over the same respectively, shall afterwards add or put any horse or other beast to any such carriage, and draw therewith upon any part of the said road, so as to increase the number of horses or other beasts drawing the carriage after the same shall have passed, whereby the payment of all or any of the tolls shall or may be evaded, or if any person shall do any other act whatever in order or with intent to evade the payment of all or any of the tolls, and whereby the same shall be evaded, every such person shall for every such offence forfeit and pay any sum not exceeding Five Pounds.

PROCLAMATION.

WHEREAS, by the 13th Section of “The Gold Fields Act, 1866,” it is enacted that it shall be lawful for the Governor to authorise the construction, by private enterprise, of any Road, Bridge, Wharf, Ferry, or other public work, for the use and benefit of the public, and to permit the occupation, for a limited period, of sites for the same, and to provide for the payment of such tolls for a limited period by all persons using the same as he shall deem reasonable, and the Governor in Council may from time to time, make, alter, and revoke regulations for collecting such tolls, and for preventing the evasion thereof, and generally for the control and management of the said roads, bridges, wharves, ferries, or other public works, and such regulations upon and after being published in the Gazette of the Province to which they may apply shall have the force of law:

And whereas, by the one hundred and ninth Section of the said Act, it is enacted that it shall be lawful for the Governor in Council under his hand and the Public Seal of the Colony, from time to time to delegate to such person as the Governor may think fit all or any of the powers vested in the Governor by the said Act, except the powers conferred by Sections twenty-two, forty, forty-eight, sixty, ninety-six, and one hundred and seven thereof, subject or not to any limitations or restrictions as he may think fit;

And whereas, by an instrument in writing, dated the third day of February, 1869, and published in the New Zealand Gazette of the eighth day of February, 1869, His Excellency the Governor did, under his hand and the Public Seal of the Colony, delegate unto me, Conrad Hoes, Chairman of the County Council of the County of Westland, all the powers vested in the Governor under or by virtue of “The Gold Fields Act, 1866,” except the powers conferred by Sections eleven, twenty-two, thirty, thirty-three, thirty-nine, forty, forty-eight, sixty, ninety-six, and one hundred and seven of the said Act, to have, hold, and exercise the said powers hereby delegated to me within the County of Westland:

And whereas, it is expedient that the undermentioned persons who have erected tolls and ferries, and constructed roads and bridges, should be allowed to collect such tolls and occupy the sites of such ferries, roads, and bridges, for the periods set opposite to their respective names:

Now therefore, I, Conrad Hoes, Chairman of the County Council of the County of Westland, in exercise of the powers in that behalf vested in and delegated to me, do hereby notify that I have appointed the undermentioned persons to be toll collectors at the ferries, roads, and bridges set opposite their respective names, on the terms as stated below, and do hereby authorise the collection of the undermentioned tolls at each of the ferries, roads, and bridges respectively.

Given under my hand, at Hokitika, this 3rd day of May, 1870.

JOHN JACKSON.

  1. The ferry to be worked by a punt, and by boats.

  2. The amount of subsidy to be £50 per annum.

  3. Occupation allowed of a strip of land on the North Spit up to the Cemetery, leaving a road on the lagoon side, and giving up part or the whole when required; compensation for improvements being allowed.

  4. Protection allowed on the north side of the lagoon, half a mile each way from the point which the punt or boat starts; but no licensed boat landing passengers, or any private boat employed by the owner for his own use, to be interfered with by the lessees, and no licensed boat shall be permitted to take up passengers on the north side of the lagoon.

  5. Term of lease, five years.
