the public service of the Colony, shall for the
purposes of this Act, and so long as they shall continue to be so held in trust, be deemed and taken to be the property of Her Majesty, and shall be paid into the Public Account and placed to the credit of the Public Trust Fund: Provided that moneys paid to any Receiver by way of deposit on account of Customs Duties or of Land Fund, moneys paid to the Post Office for transmission or to be deposited in the Post Office Savings Bank, and all other moneys consigned with any person in the public service, pending the same may become payable to the Government or repayable to the depositors, shall, so long as they shall continue to be so deposited, be deemed to be the property of Her Majesty, and to be a part of the Public Trust Fund; but such money shall not be paid into the Public Account at the Bank, but shall be dealt with and accounted for by the Officers having the custody thereof in such manner as shall be directed by the Regulations made under the authority of the said Act or of this Act.” And whereas divers sums of money, being deposits on account of Land Fund in respect of sales of land within the County of Westland, made before the separation of the said County from the Province of Canterbury, are now in the hands of William John Warburton Hamilton, as Receiver of Land Revenue for the said Province: And whereas it is expedient such sums should be transferred from the custody of the Receiver of Land Revenue for the said Province to the custody of the Receiver of Land Revenue for the said County, and that Regulations should be made enabling such transfer to be made:

Now, therefore, His Excellency Sir George Ferguson Bowen, Knight Grand Cross of the Most Distinguished Order of Saint Michael and Saint George, the Governor of New Zealand, in exercise and pursuance of all powers and authorities enabling him in this behalf, and with the advice and consent of the Executive Council of New Zealand, doth hereby make the Regulations contained in the Schedule hereto, and doth order and direct that the same shall come into force on the first day of February, one thousand eight hundred and sixty-nine.

SCHEDULE.

Regulations.

All moneys paid to the Receiver of Land Revenue for the Province of Canterbury as deposits on account of Land Fund, in respect of sales of land within the County of Westland, and being in his custody or under his control on the coming into operation of this Regulation, shall forthwith be remitted by him to the Receiver of Land Revenue for the said County, and shall be received and held by the Receiver of Land Revenue for the County upon and for the like trusts and purposes as the same were paid to and held by the said Receiver for the said Province, and shall by him be dealt with accordingly.

ORDER IN COUNCIL.

At the Government House, at Wellington, the third day of February, 1869.

Present:
His Excellency the Governor in Council.

WHEREAS by “The County of Westland Act, 1868,” it is provided that the Colonial Treasurer shall, out of the Land Fund arising within the said County, pay such salaries to the Members of the Waste Lands Board of the County as the Governor in Council shall from time to time direct: And whereas the Waste Lands Board for the said County consists by law, amongst others, of one Chief Commissioner, and it is expedient that a salary of two hundred pounds per annum should be paid out of the said Land Fund to the Chief Commissioner of such Board:

Now, therefore, His Excellency the Governor, in exercise and pursuance of the power and authority conferred on him in this behalf, and with the advice and consent of the Executive Council of New Zealand, doth hereby order that a salary of two hundred pounds per annum be paid out of the Land Fund of the said County to the Chief Commissioner of the Waste Lands Board for the said County.
