✨ Mining Leases and Legal Writs
WHEREAS by the 29th Section of "The Gold Fields Act, 1866," it is enacted that it shall be lawful for the Governor in Council to demise for mining purposes, to any person, for any term not exceeding fifteen years from the making of the lease, any auriferous Crown Lands, not exceeding ten acres in the whole of alluvial ground, and to grant titles for machinery and any necessary easements for the purposes aforesaid, subject, nevertheless, to the conditions or provisions in the said section contained:
And whereas, His Excellency Sir George Ferguson Bowen, the Governor of New Zealand, did, on the third day of February, 1869, with the advice and consent of the Executive Council of the Colony, delegate unto me, Conrad Hoes, Chairman of the County Council of the County of Westland, the power vested in him by the twenty-ninth section of "The Gold Fields Act, 1866":
Now therefore, I, Conrad Hoes, Chairman of the County Council of the County of Westland, in exercise of the powers vested in me in that behalf, do hereby give notice that, on the third day of November, 1869, I intend to demise to the persons named in the Schedule hereto annexed, certain auriferous Crown Lands of alluvial ground, for the term specified in the said Schedule.

To JOHN DURHAM of Hokitika, in the County of Westland, New Zealand, Storeman, Greeting :
WHEREAS an action is now pending in our Supreme Court of New Zealand, in the Westland District, between William Belcher and Charles Fairweather, trading as "Belcher and Fairweather," of Kaiapoi, in the Colony of New Zealand, Contractors, plaintiffs, and Henry Staite, trading as "Staite and Company," of Hokitika, in the County of Westland, and Colony aforesaid, Merchant; and, in order that the plaintiffs may proceed in their action, We command you that you do retain and keep all and singular lands and hereditaments, moneys, and chattels, bills, bonds, and other property of whatsoever nature in the custody or under the control of you at the time of the service of this writ, belonging to the above-named defendant, Henry Staite, or to which such defendant shall at that time be legally or equitably entitled, or otherwise beneficially interested, and whether solely or jointly with any other person or persons, and all debts of any kind then due by you to such defendant, although the same or any part thereof may be payable at a future day.
And we further command you that you in your own proper person be and appear before such Judge of our said Court as shall be sitting in Chambers, on Monday, the tenth day of January, 1870, at ten o’clock in the forenoon, or so soon thereafter as shall thereafter be appointed, and to be examined touching the premises, and to do and receive what shall then and there be considered of you in that behalf, and this you shall in no wise omit.
Witness—CHRISTOPHER WILLIAM RICHMOND, Esquire, Judge of our said Court at Hokitika, this twenty-first day of October, 1869.
