Bye-Law of the Council of the Borough of Wellington.

Made under the Provisions of "The Municipal Corporations Act 1867," and "The Municipal Corporations Acts Amendment Act 1871."

IN pursuance of Section 181 of "The Municipal Corporations Act, 1867," and of Section 3 of "The Municipal Corporations Acts Amendment Act, 1871," the Council of the Borough of Wellington ordain as follows (that is to say)β€”

The several provisions of the Thirteenth Schedule to "The Municipal Corporations Act, 1867," are hereby adopted in and for the said Borough.

All bye-laws or regulations, or parts of bye-laws or regulations, heretofore in force in and for the said Borough of Wellington which are inconsistent with or repugnant to the provisions of the said Thirteenth Schedule are hereby repealed.

Passed by the said Council this twelfth day of January, in the year of our Lord one thousand eight hundred and seventy-two.

The Seal of the Borough has been affixed hereto this twelfth day of January, 1872, pursuant to special order of the Council.

City Council Regulations.

WE, the Mayor and Councillors of the City of Wellington, pursuant to the powers and provisions contained in "The Municipal Corporations Act, 1867," do make and ordain the following Regulations:β€”

No. 1.

A REGULATION made under authority of Section 4, Sub-division 1, Part 1, of Schedule 13 of said Act, "For regulating the height from the ground, shape, figure, dimensions, and material of porticos."

  1. No portico shall be of less height than nine feet from the curb to the soffite of the fascia, measured in the centre of the portico; nor higher than nine feet, unless the permission of the City Council has been first obtained in either case.

  2. All porticos shall be erected in accordance with plan and specification deposited in the office of the Town Clerk, and shall be constructed to the satisfaction of the City Council.

No. 2.

A REGULATION made under the authority of Section 14, Sub-division 3, Part 1, of Schedule 13, of said Act, "For regulating the formation, &c., of drains to be laid under any footway or channel."

  1. All drains under footways shall be constructed with iron pipes, or plain glazed earthenware, not exceeding four inches internal diameter, and shall be laid with a fall of not less than three inches in nine feet, the level at the discharge mouth being the level of the water channel.

  2. The curbing shall be neatly cut with a circular hole of the same size as the outer diameter of the pipe to receive the end of the pipe.

  3. The footway opened up for the reception of the pipe shall be made good with the same material as that of which it is constructed.

  4. No drain under a footway and discharging into the channel shall be laid for any other purpose than for carrying off surface water, whether from yards or roofs.

No. 3.

A REGULATION made under the authority of Section 26, Sub-division 4, Part 1, of Schedule 13, of said Act, "For regulating the formation, &c., of crossings across or over the footways or channels."

  1. No crossing shall be more or less than nine feet long in the direction of the street, unless the permission of the City Council has been first obtained.

  2. All crossings shall extend over the full width of the footway, and have such inclination towards the channel, and be set to such gradients as the case may require.

  3. Both sides of any crossing laid in any street or part of a street, having stone kerbings, shall be laid with straight axed dressed bluestone kerbing, twelve by eight in section, and not less than two feet long, having at each end quadrants of two feet radius. The crossing in such case shall be laid with bluestone cubes nine inches deep, four inches wide; and any length over fifteen inches.

  4. Both sides of any crossing laid in any street or part of a street, having hardwood kerbing, may be laid with hardwood planking nine inches deep and three inches thick at each end quadrants cut from solid timber of two feet radius. The crossings in such cases shall be laid with cubes, as set forth in clause three, or laid with well-prepared asphalte or Portland cement concrete, to the satisfaction of the City Surveyor.

  5. All crossings shall be laid on a well-prepared bed with materials approved by the City Council.
