Debtors and Creditors Act Notices




Supreme Court House, at Wellington aforesaid; and that a meeting of the creditors of the said John Hamlin be held at the Grand Jury Room of the said Supreme Court House, on the fifteenth day of July instant, at the hour of eleven o’clock in the forenoon, for the purpose of recommending Trustees and the mode of winding up the said estate, and that in the meantime Abraham Harris, giving security to the satisfaction of the Registrar of this Court, be appointed ad interim sequestrator of the said estate. And it is further ordered that this present order shall be a vesting order, as provided by the Debtors and Creditors Act Amendment Act, 1865: Provided, however, that nothing herein contained shall protect the person of the said petitioner from any writ of arrest which may issue against him under the Writ of Arrest Act to the satisfaction of a Judge of this Honorable Court, or of a Registrar thereof, in the absence of a Judge.

In the Matter of William Avernall, of Wellington, in the Province of Wellington, Butcher, a prisoner confined in Her Majesty’s Gaol at Wellington for Debt, a Bankrupt:

On the twentieth day of July, in the year of our Lord one thousand eight hundred and sixty-six:

On reading the Petition of the said William Avernall, filed in this Court, and on hearing Mr. Izard, of counsel for the said petitioner, it is ordered that the said petition be accepted, and that the said petitioner do come up for hearing at the Supreme Court-house, Wellington, on Monday, the Twenty-seventh day of August next, at the hour of Eleven o’clock in the forenoon, for the purpose of recommending Trustees for the said Estate, and the mode of winding up the same, and that in the meantime Alfred Abraham Barnett, of Wellington aforesaid, auctioneer, be appointed ad interim Sequestrator of the said Estate, on his giving security to the satisfaction of the Registrar of this Honorable Court. And it is further ordered that this present order shall be a vesting order in accordance with the provisions of the said last recited Act, provided, however, that nothing herein contained shall protect the person of the said petitioner against any process that may be issued against him under the Writ of Arrest Act to the satisfaction of a Judge of this Honorable Court, or of a Registrar thereof in the absence of such Judge.

On reading the Petition of Robert Campbell, and the several affidavits filed herewith, and on hearing Mr. Izard, of counsel for the said petitioner, it is ordered that the said petition be accepted, and that the said petitioner come up for hearing on the Eighth day of November next, at the hour of Ten o’clock in the forenoon, at the Supreme Court-house, at Wellington, and that a meeting of the creditors of the said Robert Campbell be held at the Grand Jury-room, Supreme Court-house, Wellington, on the Twenty-ninth day of October next, at the hour of eleven o’clock in the forenoon, for the purpose of recommending Trustees and the mode of winding up the said Estate, and that in the meantime William Hogg Watt, of Wanganui aforesaid, giving security to the satisfaction of the Registrar of this Honorable Court, be appointed ad interim Sequestrator of the said Estate, until the said Eighth day of November, or until the further order of this Court. And it is further ordered that this present order shall be a vesting order in accordance with the provisions of the said last recited Act, provided, however, that nothing herein contained shall protect the person of the said petitioner against any process that may be issued against him under the Writ of Arrest Act to the satisfaction of a Judge of this Honorable Court, or of a Registrar thereof in the absence of such Judge.
