No. 14.] THE NEW ZEALAND GAZETTE. [19th April, 1845.

GOVERNMENT HOUSE, AUCKLAND.

PROCLAMATION.

By His Excellency Sir George Grey, Knight Commander of the Most Honourable Military Order of the Bath, Governor and Commander-in-Chief in and over the Islands of New Zealand, and its Dependencies, and Vice-Admiral of the same, &c., &c., &c.

Whereas by an Act of the Imperial Parliament, passed in the session holden in the third and fourth years of Her present Majesty, intituled, "An Act to provide for the Administration of Justice in New Zealand," it is, amongst other things, enacted, that it shall be lawful for the Governor of New Zealand, from time to time, by Proclamation, to establish such Courts of Judicature and Public Offices, and to appoint such Officers thereof, as may be necessary for the due administration of Justice and the public service within the said Colony:

Now, therefore, I, the Governor of New Zealand, in pursuance of the powers vested in me as aforesaid, and of all other powers and authorities enabling me in that behalf, do hereby proclaim and declare that a Court of Requests is and shall be established within the said Colony of New Zealand, and that the said Court shall be holden at Auckland, in the Northern Island of New Zealand, and shall have jurisdiction and cognizance of all such matters and causes as are now cognizable by the Courts of Request in England, the debt or damage not exceeding the sum of Ten Pounds sterling.

And I do hereby further proclaim and declare, that the following persons shall be and are hereby appointed Commissioners of the said Court of Requests, to hold office during pleasure:

  • The Honourable William Swainson, Attorney-General.
  • Thomas Outhwaite, Esquire.
  • John Campbell, Esquire.
  • John Logan Campbell, Esquire.
  • John Salmon, Esquire.
  • William Brown, Esquire.

And I do hereby appoint the said Thomas Outhwaite, Esquire, to be Registrar of the said Court of Requests.

And I do hereby further direct and appoint, that the said Court of Requests shall hold its first sitting at Auckland aforesaid, on the first Tuesday in the month of June next, at the hour of ten in the forenoon, and that the said Court shall thereafter hold its sittings at Auckland aforesaid, on the first Tuesday in every month, at the same hour.

Given under my hand and seal at Government House, Auckland, this 18th day of April, in the year of our Lord One thousand eight hundred and forty-five.

GOVERNMENT NOTICES.

Colonial Secretary’s Office, Auckland, 18th April, 1845.

His Excellency the Governor directs it to be notified, for general information, that the following regulations will in future be observed with regard to applications for grants of land in the Colony:

  1. Every application must be made in writing, addressed to the Colonial Secretary, and must state:

    • The name of the applicant.
    • His place of residence.
    • The quantity of land applied for.
    • The situation and boundaries of such land, so far as they can be described.
  2. No application will be attended to unless accompanied by a sketch or tracing of the land applied for, such sketch to be upon a scale of not less than forty chains to an inch...

  3. No application will be received for a larger quantity of land than 2,560 acres, or four square miles...

  4. Every applicant must state whether he is a married man, and if so, the number of his family...

His Excellency is also pleased to direct that the fees payable upon the issue of Crown grants shall in future be as follows:

  • For every grant not exceeding 100 acres ... 5s.
  • For every grant exceeding 100 acres, and not exceeding 500 acres ... 10s.
  • For every grant exceeding 500 acres ... £1

The above fees are exclusive of the expense of survey, which must be borne by the applicant.

Notice to Mariners.

Vessels entering the harbour of Auckland are hereby cautioned against anchoring in the fairway of the channel, which lies between the North Head and the point of land on which the lighthouse is situated, as great danger may be apprehended from so doing.

Masters of vessels are also informed that the course to be steered in entering the harbour is W.N.W. until the leading mark (a clump of trees on the North Shore) is brought on with the summit of Rangitoto, bearing North...
