Sir,—In compliance with your request,
now for the first time made to me, I beg
to forward to you a Copy of the Colonial
Secretary’s letter, in answer to mine of
the 2nd of April, tendering my resignation
of the office of Superintendent.

Colonial Secretary’s Office,
Auckland, 23rd April, 1858.
Sir,—In reply to your letter of the 2nd
instant, addressed to the Governor,
placing in his Excellency’s hands the
resignation of your office as Superin-
tendent of the Province of Wellington,
I have the honor to inform you that His
Excellency has this day, on behalf of
Her Majesty, accepted that resignation.

With reference to the last paragraph
of your letter, I have to observe that the
provisions in the 4th Section of the Constitution
Act, to the effect that every Superin-
tendent shall hold office until the
election of his successor, applies only to
the case of the termination or dissolution
of the Provincial Council.

In accordance with this view, which
has always hitherto been acted on, the
General Assembly made provision last
session, in the 4th Section of the
Superintendent’s Deputy Act, 1856, for cases of resignation.
