PROCLAMATION.

By His Honor Isaac Earl FATHERSTON, Esquire, Superintendent of the Province of Wellington in the Islands of New Zealand.

WHEREAS by an Act of the Provincial Council of Wellington, Session I., No. 21, intituled "An Act to provide for the making, maintaining, repairing, and management of Country Roads within the Province," Provisions were made for the establishment of Districts within which, rates upon Land should be levied for the making, maintenance, repair, and improvement of highways then, and thereafter to be made therein, and also for constituting Boards of Commissioners for carrying out the Provisions of the said Act within such Districts. And in the said Act were contained certain enactments with respect to Offences against the Board and Roads comprising the Clauses of the said Act, 88 to 102 inclusive:

And Whereas, by a certain Act of the Provincial Council of Wellington, Session II., No. 8, intituled "An Act to vest in the Superintendent, and his Executive Council, the management of Roads in Districts for which Boards of Commissioners for such purpose may not be constituted," It was enacted,

"That the management and control of all highways within the Province, except in those Districts for which Boards of Commissioners for such purposes should be constituted, should be vested in the Superintendent and his Executive Council. And also, that the Superintendent with the consent of his Executive Council might, by Proclamation, declare that all, or any of the enactments contained in the said Act of the First Session, No. 21, imposing Penalties for Offences against the Roads and Board, should be in force with respect to any highway under his control.

And Whereas, it is deemed expedient that the enactments with respect to offences against the Board and Roads hereinbefore referred to, should be made applicable to the Road from Wellington to Petone:

Now therefore I, Isaac Earl Fatherston, Superintendent of the Province of Wellington in the Islands of New Zealand, do hereby proclaim, by virtue of the powers vested in me by the hereinbefore recited Acts, that from and after the publication of this Proclamation, the enactments contained in the 88th to 102nd Clauses inclusive of the hereinbefore recited Act of the First Session of the Provincial Council, No. 21, imposing Penalties for Offences against the Roads and Board, shall apply to the Road from Wellington to Petone."
