APPOINTMENT OF HARBOUR MASTER.

IN exercise of the authority delegated to me by His Excellency the Governor under the Marine Act, 1866, I hereby appoint
HENRY JOHN HORNBY
to be Harbour Master for the Port of New Plymouth, vice John Gibson. The appointment to date from the 19th ult.

WAIWAKAIHO, WAITARA, AND URENUI FERRIES.
NOTICE
Revoking previous Regulations, &c., and re-issuing the same with alterations.

New Plymouth, February 4, 1867.
WHEREAS by the third section of an Ordinance of the Superintendent and Provincial Council of the Province of New Plymouth intituled “An Ordinance to establish and regulate Ferries,” passed in the second session of the said Council, it is, amongst other things, provided that it shall be lawful for the Superintendent from time to time, by notice in the Government Gazette of the Province, to fix, alter, or repeal the dues to be taken at any Ferry within the said Province, and to make Regulations for and concerning the management of Ferries in general throughout the said Province, or of particular Ferries. And whereas by the sixth section of the said recited Ordinance it is provided that no such notice shall be published during a session of the Provincial Council without the previous consent of the Provincial Council expressed by a resolution thereof:
Now therefore I, HENRY ROBERT RICHMOND, Esquire, Superintendent of the Province of Taranaki (formerly New Plymouth) do hereby repeal all previous notices which have been issued for the regulation of Ferries in the said Province and for fixing the dues chargeable thereat; for the purpose of altering the regulations previously published and extending the operation thereof to the Waitara and Urenui Ferries, and also of altering the dues chargeable at the said Ferries respectively, such extension and alterations having been approved by resolutions of the Provincial Council.
And I hereby declare that the following Regulations shall henceforward extend and apply to the Ferries over the Waiwakaiho, Waitara, and Urenui Rivers on the North road, and that the scales of dues below specified shall be charged at the said Ferries respectively.
Regulations for the management of the Waiwakaiho, Waitara, and Urenui Ferries.
Ferry Keeper.
The Ferry-keeper or his substitute shall be in constant attendance for the conveyance across the river of passengers, but shall not be required to convey either goods or sheep between dark in the evening and daylight in the morning.
Ferry Boat.
The Ferry-boat shall be properly secured by the Ferry-keeper, and kept in a clean and efficient state for use.
Definition of the words “daylight” and “dark.”
The words daylight and dark where they occur in these regulations and in the following scales of dues shall be taken to mean the hours of 6 a.m. and 7 p.m. respectively during the summer half-year commencing on the 1st October in each year, and 7 a.m. and 6 p.m. respectively during the winter half-year commencing on the 1st April in each year.
Penalties.
A penalty not exceeding Forty Shillings will be imposed for each of the following offences:
For the breach of any of the foregoing Regulations by the Ferry-keeper or his substitute.
For interfering with or injuring the Ferry-boat, or the tackle, or other property belonging thereto.
For making use of the Ferry-boat without the cognisance of the Ferry-keeper (unless the absence of the Ferry-keeper, or his substitute, be satisfactorily proved).
Provided that in case the damage to the Ferry-boat, or property thereof, exceed the sum of Forty Shillings, the same shall be recoverable at common law instead of under the Ferries Ordinance, Session 2, No. 6.

The following charges are authorised to be made for the use of the Waiwakaiho, Waitara, and Urenui Ferries respectively...
