NOTICE TO RATEPAYERS.
SIXTH DISTRICT.
Provincial Treasurer's Office,
New Plymouth, 23rd August, 1858.
THE time appointed for the payment of the rates imposed on the Sixth district for the year 1857-8 having expired, Notice is hereby given that unless the same be paid at this Office on or before the seventh day of September next, proceedings will be taken for the recovery thereof conformably with the 27th clause of the "Roads and Bridges Ordinance, 1858."

IN pursuance of the powers vested in me by the "Roads and Bridges Ordinance, 1858," I, the Superintendent of the Province of New Plymouth, do hereby appoint that the Rates imposed on the lands within the several districts particularised in the annexed schedule shall be paid to the Provincial Treasurer at his office, on the 15th day of October next.

THE following Resolutions adopted by the Provincial Council at the sitting held on Wednesday the 18th inst., are published for general information.

Resolutions for granting a Lease of the Sea Beach to Edward Morshead for smelting and working the Iron Sand.
That Edward Morshead, of New Plymouth, being desirous to form a Company for the purpose of smelting and working the Iron Sand of this Province, and having applied for a lease of the Sea Beach and the unoccupied land adjacent, this Council approves of a lease of the same respectively being granted to the said Edward Morshead on the following terms.

The lease to be for a term of 23 years, and to include all land above and below high water mark, seaward of sections, roads and reserves in the purchased districts.

The said Edward Morshead his heirs or assigns shall smelt and work the said sand in the Province in a proper and workmanlike manner, and shall pay monthly to the Provincial Treasurer a royalty or rent of one twentieth of the gross proceeds of all sales made by him or them of the same.

In the event of the said Edward Morshead his heirs or assigns being desirous to renew the lease on or before the expiration of the same (the lease not having been otherwise determined), his or their claim shall have priority of consideration.

If at any time on being required so to do by the Superintendent, the said Edward Morshead his heirs or assigns shall not prove to the satisfaction of an officer to be appointed by the Superintendent for that purpose that a sum or liability of not less than Β£500 has been spent or incurred within the preceding period of six months in the working of the said sand or in other matters subsidiary thereto, then it shall be lawful for the Superintendent with the approval of the Provincial Council, expressed by a resolution of the same, to enter upon the land and absolutely determine the said lease, anything therein to the contrary notwithstanding.

Such of the terms as relate to the expenditure of Β£500 in every six months, the payment of the royalty or rent, the working of the sand, and the determination of the lease before the expiration of the full term, shall have no force or effect until after the expiration of two years from the date of the lease.

An officer to be appointed for that purpose by the Superintendent, shall at all times have free access to all the works, and the books, papers, and vouchers connected with or concerning the working of the said sand. Provided that it shall be competent to the said Edward Morshead his heirs or assigns, at any time to object to such officer, and at his or their option to memorialise the Provincial Council, whose decision in the matter shall be final.
