  1. The provisions of the lease are not to interfere with the free use by the Public of the Sea Beach and of the sand thereon, for all purposes except for exporting the said sand, or for smelting, or otherwise converting the same into metal during the continuance of the lease. Provided that the latter restrictions shall not take effect until the 1st day of July 1860.

  2. That this Council is of opinion that no lease should be granted to any person or company for the term of seven years from the date of the present proposed lease of any sea frontage to any land within the Province or which may hereafter be acquired from the aborigines and that the said Edward Morshead his heirs or assigns (if they fulfil the intent and meaning of the present proposed lease) should have the opportunity of obtaining a lease of such sea frontage on terms to be hereafter decided upon in preference to any other person or persons.
