β¨ Provincial Legislative Ordinance
An Ordinance to regulate the Appointment of Provincial Officers.
Whereas it is expedient to make provision for the appointment of persons to the Offices which are now or may hereafter be required for the good government of the Province of New Plymouth, and to regulate the holding of such offices:
Be it enacted by the Superintendent of the Province of New Plymouth, with the Advice and Consent of the Provincial Council thereof, thatβ

It shall be lawful for the Superintendent, from time to time, by warrant under his hand, to appoint fit persons to all such offices and employments as are or may be created or provided for by any Law or Ordinance of the Provincial Legislature, subject and except as hereinafter provided.

The Superintendent shall, within seven days from the date of each appointment made by him under the authority of this Ordinance, communicate such appointment to the Speaker of the Provincial Council, to be laid before the Provincial Council at its next sitting.

It shall be lawful for the Speaker of the Provincial Council, from time to time, by warrant under his hand, to appoint fit persons to such offices for the service of the said Council as are or may be created or provided for as aforesaid.

All appointments made by the Speaker shall be laid before the Provincial Council for approval at the first sitting following such appointments; and if disapproved of by the said Council, by any resolution passed within the space of one calendar month from such first sitting, shall be null and void as from the time of such disapproval.

It shall be lawful for the Superintendent at pleasure to dismiss or to suspend from the exercise of office any provincial officer, not being an officer appointed by the Speaker of the said Council.

On being thereunto requested by a Resolution of the Provincial Council, the Superintendent shall lay before the Council a written statement of the grounds for the dismissal or suspension of any Provincial Officer.

It shall be lawful for the Speaker of the Provincial Council, at pleasure, to suspend from the exercise of his office any officer appointed for the service of the said Council, until such time as such suspension can be laid before the Provincial Council for confirmation or disallowance. And it shall be competent to the said Council either to disallow or to continue such suspension, or absolutely to dismiss such officer.

It shall be lawful for the Superintendent, and also for the officer in chief command of the Police Force in the said Province, to dismiss or suspend from employment any constable serving in the said Force.

It shall be lawful for the Superintendent, and also for the Harbor Master of the Port of New Plymouth, to dismiss or suspend from employment any boatman or other person serving in the Harbor Department of the said Province.
