THE following Regulations made by the Waste Land Board of the Province of Otago, under the provisions of the "Otago Waste Lands Act, 1872," having been approved of by His Honor the Superintendent, are now published in accordance with the requirements of the said Act.

Regulations for the Management of Pasturage within the Hundreds of Otepopo, Hawksbury, Dunedin, East Taieri, Tuturau, Waikaia, Waikaka, Otaria, Catlin’s, and Lee Stream :—

The Otepopo Hundred is computed as being capable of depasturing 130 head of great cattle.
The Hawksbury Hundred is computed as being capable of depasturing 40 head of great cattle.
The Dunedin Hundred is computed as being capable of depasturing 130 head of great cattle.
The East Taieri Hundred is computed as being capable of depasturing 140 head of great cattle.
The Tuturau Hundred is computed as being capable of depasturing 100 head of great cattle.
The Waikaia Hundred is computed as being capable of depasturing 380 head of great cattle.
The Waikaka Hundred is computed as being capable of depasturing 132 head of great cattle.
The Otaria Hundred is computed as being capable of depasturing 1,235 head of great cattle.
The Catlin’s Hundred is computed as being capable of depasturing 5,100 head of great cattle.
The Lee Stream Hundred is computed as being capable of depasturing 1,624 head of great cattle. -
Every person depasturing or desiring to depasture cattle upon the unfenced waste lands within any Hundred shall, on or before the first day of December in every year, furnish to the Waste Land Board a return in the form or to the effect of the Schedule hereto showing the number of acres of land owned or occupied by him, and the number, description, and brands of all cattle depastured, or intended to be depastured by him within the Hundred, and any person depasturing cattle upon any Hundred failing to make such return as aforesaid, or making a false return, shall be liable to a penalty of £20, to be recovered in a summary way.

Every license shall commence and take effect on the first day of January, and shall continue in force one year, and for such license there shall be paid to the Waste Land Board the sum of two shillings and sixpence.

Each license holder shall be at liberty to depasture, free of assessment, one head of great cattle or five sheep for every ten acres of unenclosed land owned or occupied by him within the boundaries within which cattle may be depastured in the Hundred, provided that such license holder shall prove to the satisfaction of the Board that such freehold land is within such boundaries, and is open to all cattle depastured on the Hundred.

Each license holder who is the holder of a miner’s right, having a claim within the Hundred, or who is the holder of a business license issued under any Gold Fields Act, occupying land by virtue of license within the Hundred, shall be entitled to run two head of great cattle within the Hundred free of charge.

If any person not being licensed as aforesaid shall depasture any cattle on the common Waste Lands within the Hundred, or being so licensed, shall depasture on such Waste Lands as aforesaid a greater number of cattle than shall have been apportioned to him, every such person shall be liable to a penalty of not exceeding fifty pounds.

Any license holder may be required by the Ranger at any time to make a return in the form provided in the Schedule hereto, and any person who shall fail to make such return for a period of 48 hours after being required so to do, or who shall make a false return, shall be liable to a penalty of £20.

No diseased cattle shall be depastured upon nor shall any pigs or goats be allowed at large within any Hundred, and any person or persons who shall turn out or depasture any diseased cattle, or suffer any pig or goat to be at large within any Hundred shall be liable to a penalty of £5, to be recovered in a summary way.

In the event of scab breaking out in any flock of sheep which are being depastured within any Hundred, the Waste Lands Board, in conjunction with the Government Sheep Inspector, shall take such steps as they may deem necessary to eradicate and prevent the spread of the disease.

Any license holder depasturing sheep upon any Hundred shall do so within such limits as the Waste Land Board may appoint, and, in the event of such sheep being allowed to trespass beyond the boundaries so appointed, they may be impounded in manner provided by section 18 of the "Otago Waste Lands Act 1866 Amendment Act 1869," and in assessing the number of sheep which may be depastured, five sheep shall be equivalent to one head of great cattle.

No entire animal above six months of age, except horses (which may be twelve months), and rams, when put to the ewes in season, and no animal of a vicious or otherwise objectionable character, shall be depastured, or allowed to be at large, on the unfenced lands in any Hundred; and any person or persons who shall turn out or depasture any entire animal over the above specified ages, or any animal of a vicious or otherwise objectionable character, or otherwise offending against these regulations, shall be liable to a penalty of £5, to be recovered in a summary way.

All unbranded cattle above six months of age depasturing on the Crown Lands within any Hundred shall be liable to be impounded, in manner provided by section 123 of the Otago Waste Lands Act, 1872.

Any cattle found depasturing on any Hundred, not being the property of or in the custody of a license holder, or depasturing on any Hundred in contravention of these Regulations, may be impounded, and the owner or custodian of such cattle shall forfeit and pay for every such offence the sum of £5, to be recovered in a summary way.

Any person disturbing or harassing cattle, great or small, depastured within the Hundred, shall be liable to a penalty of £5, to be recovered in a summary way, provided always that any person holding a license to depasture cattle within the Hundred, or any person duly authorised by him, may drive cattle so depastured for the purpose of collecting such of them as may belong to him, and for the legitimate use of the right to pasture within the Hundred: but in case it should be necessary for such purpose to drive any cattle belonging to any other person a greater distance than one mile, the person so driving such cattle must take them to the nearest stock-yard and there separate his own cattle from those of other persons, and return the latter to the place from whence they were driven.
