PROCLAMATION

Setting apart Land in the Otaramika District; occupation on deferred payments.

By His Honor James Macandrew, Esquire, Superintendent of the Province of Otago.

WHEREAS by the fifth section of the Act of the General Assembly of New Zealand, intituled “The Southland Waste Lands Act Amendment Act, 1873,” it is enacted that it shall be lawful for the Superintendent, with the advice and consent of the Provincial Council, to set aside lands for sale on deferred payments, such lands to be sold and dealt with in terms of and subject to the conditions and provisions embodied in sections forty-seven to sixty-four inclusive of “The Otago Waste Lands Act, 1872:” And whereas the Provincial Council of the Province of Otago has recommended the Superintendent of the said Province to set apart the lands hereinafter specified for alienation on deferred payments:

Now therefore I, James Macandrew, Superintendent of the Province of Otago, by and with the advice and consent of the Provincial Council as aforesaid, do hereby, by virtue and in exercise of the powers conferred upon me by “The Southland Waste Lands Act Amendment Act, 1873,” and of every or any power in this behalf enabling me, proclaim, declare, and set apart all that district or block of land containing by estimation 2584 acres, more or less, situate in the Otaramika Hundred, being sections numbered respectively 17, 27, 28, 29, 30, 31, 32, 33, 34, 35, 36, and 37, block I., and sections numbered respectively 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 14, 15, 22, 23, 24, 25, and 26, block II., on the map of the said Hundred, as a district within which land may be sold on deferred payments on and after the 29th day of July 1874.

Given under my hand, and issued under the public seal of the Province of Otago, this twenty-third day of June, 1874.

ORDER IN COUNCIL.

At the Provincial Government Buildings, Dunedin, this 15th day of June, 1874.

Present—His Honor James Macandrew, Superintendent,
Donald Reid, George Turnbull, Duncan M’Kellar,
George Lumsden, and George Murray Webster,
Esquires, Members of the Executive Council.

WHEREAS by the thirty-sixth section of the “Turnpikes Ordinance, 1866,” it is provided that the Superintendent and Executive Council may cause check-bars to be placed on any district road in the said Province, and may cause tolls to be levied at such bars, and taken from such persons who may travel by such district roads for the purpose of evading tolls leviable on the main roads, provided that one-half of such tolls shall be handed to the District Board in which the road or roads is or are situated: Now therefore His Honor the Superintendent, in pursuance of the provisions of the said Ordinance, and in exercise of every power and authority enabling him in that behalf, and by and with the advice and consent of his Executive Council, doth hereby order that a check-bar be placed on the district road of Southbridge where the same turns off from the Main South Road, and that tolls be levied at such bar, and taken from such persons who may travel by such district roads for the purpose of evading tolls leviable on the said Main South Road, and that one-half of the tolls so levied at such check-bar be handed to the District Board of the Tokomairiro Road District.

PUBLIC NOTIFICATION.

IN conformity to the 29th section of the “Gold Fields Act, 1866,” and to the regulations made under that Act and the Gold Fields Acts Amendment Acts of 1867, 1868, and 1869, for the granting of leases for gold-mining purposes on Crown Lands to the applicants specified in the annexed Schedule, unless there shall be valid objections against granting such lease.

Objections to the granting of such lease, stating the grounds of objection, must be made in writing and lodged with the Warden at Cromwell, on or before the 7th day of August, 1874.

Copy of the application made, and plans annexed, may be seen at the Warden’s Office at Cromwell.

Given under my hand at Dunedin, this 29th day of June, one thousand eight hundred and seventy-four.

SCHEDULE.

John Lumley Edwards, on behalf of Williams and Edwards, for ten acres of land, more or less, as the same may be found after survey, to be within the pegs and trenches of the applicants, situated at Royal Standard Saddle, Carrick Range.
