To Latham Osborne Beal, of Dunedin, in the Province of Otago, New Zealand, Bank Manager, and John Jackson and Arthur Jackson, of Port Chalmers, in the said Province, Ship Carpenters, carrying on business together in co-partnership, under the firm or style of “Jackson Bros.”
GREETING:
WHEREAS an action is now pending in our Supreme Court of New Zealand, Otago and Southland District (No. 4295), between the Bank of New Zealand, of Dunedin aforesaid, Bankers, Plaintiffs, and Henry Wissenden, formerly of Dunedin aforesaid, Hotelkeeper, but now of parts beyond the seas, Defendant; and in order that the plaintiffs may proceed in the said action:
We command you, that you and each of you, do retain and keep all and singular lands and hereditaments, moneys, chattels, bills, bonds, and other property of whatsoever nature in the custody or control of you, or either of you, at the time of the service of this Writ, belonging to the said Henry Wissenden, or to or in which such defendant shall at that time be legally or equitably entitled, or otherwise beneficially interested in, and whether solely or jointly with any other person or persons, and all debts of every kind then due by you, or either of you, to such defendant, although the same or part thereof may be payable only at a future day: And we further command you, that you and each of you, in your own proper persons, be and appear before such Judge of our Supreme Court as shall be sitting in Chambers on Tuesday, the thirtieth day of June instant, at eleven o’clock in the forenoon, and then and there to be examined touching the premises, and to do and receive what shall then and there be considered of you in that behalf; and this you shall in no wise omit.
Witness His Honor Henry Samuel Chapman, Esquire, Judge of our Supreme Court of New Zealand, at Dunedin aforesaid, this seventeenth day of June, one thousand eight hundred and seventy-four.
