PROCLAMATION

Of Regulations for the depasturing of Stock within the Tuapeka Depasturing District.

By His Honor James Macandrew, Esquire, Superintendent of the Province of Otago.

WHEREAS Regulations have from time to time been made for the depasturing of stock within the Tuapeka Depasturing District, as provided for by the fourteenth section of "The Goldfields Act, 1866." And whereas it is expedient to make further regulations for the depasturing of stock within the said district:

Now, therefore, I, James Macandrew, Esquire, Superintendent of the Province of Otago, by and with the advice and consent of the Executive Council of the said Province, do hereby, by virtue and in exercise of the powers delegated to the Executive Government of the said Province in this behalf by His Excellency the Governor-in-Council, under the authority of "The Gold Fields Act Amendment Act, 1867," and of every or any other power in any wise in this behalf enabling me, proclaim and declare that the Regulations following shall be Regulations for the depasturing of stock within the said Tuapeka District, in addition to those already in force.

DEPASTURING REGULATIONS.

Otago Gold Field—Tuapeka District.

  1. No sheep shall be depastured within the District, unless a portion of the district be set aside for that purpose.

  2. No bull over the age of six months, or entire horse over the age of twelve months, shall be depastured within the district without the consent in writing of a majority of the Wardens for that purpose first had and obtained.

  3. It shall not be lawful to disturb unnecessarily any stock legally depasturing within the district.

  4. It shall not be lawful to remove cattle above ten (10) in number, nor to drive above the same number from or through the district, unless the person or persons so doing shall have given to the Chairman of the Board of Wardens twenty-four hours previous notice of his or their intention so to do.

  5. Any person or persons removing cattle from the District shall drive the cattle which he or they shall collect to the nearest stockyard, and there separate his or their cattle from the other cattle, and drive the latter back to the place from whence they were taken.

  6. It shall be lawful for the Board of Wardens to authorise the mustering of stock illegally depasturing within the District, and the owner or owners of such stock shall be held liable for the expenses incurred in mustering.

  7. It shall be lawful for the Board of Wardens to authorise the impounding of stock illegally depasturing within the District.

  8. No pigs or goats shall be allowed to be at large within the District.

Given under my hand, and issued under the public seal of the Province of Otago, in presence of George Turnbull and Horace Bastings, Esquires, two members of the Executive Council of the said Province, being also members of the Provincial Council thereof, this twenty-eighth day of February, One thousand eight hundred and seventy-four.

PROCLAMATION

Of Regulation relating to applications for Agricultural Leases.

By His Honor James Macandrew, Superintendent of the Province of Otago.

WHEREAS by the thirty-ninth Section of "The Gold Fields Act, 1866," it is enacted that it shall be lawful for the Governor from time to time to make regulations prescribing the mode in which applications may be made for leases of land for agricultural purposes:

And whereas His Excellency the Governor did by a Proclamation issued under his hand and the seal of the Colony of New Zealand, bearing date the ninth day of July, One thousand eight hundred and seventy-three, delegate unto the Executive Government of the Province of Otago, his powers under the said thirty-ninth section of "The Gold Fields Act, 1866:"

And whereas a Regulation has been made to the effect that every Application for an Agricultural Lease of Crown Lands must be for one or more sections as surveyed, and not for a portion or portions of a section or sections:

And whereas it is expedient to amend the said Regulation so that Applications for Agricultural Leases may be made for a portion or portions of a section or sections.

Now therefore, I, James Macandrew, Superintendent of the Province of Otago, by and with the advice and consent of the Executive Council of the said Province, and in exercise of the powers conferred upon me by "The Gold Fields Act, 1866," and of every or any other power in anywise in this behalf enabling me, do hereby proclaim...
