ORDER IN COUNCIL.
At the Provincial Government Buildings, Dunedin, this ninth day of December, one thousand eight hundred and seventy-three.
Present:
His Honor the Superintendent,
George Turnbull, and
Horace Bastings, Esquires.
WHEREAS by the second section of “The Salmon and Trout Act 1867,” the Governor of New Zealand is authorised to make, rescind, or vary Regulations for preserving and propagating Salmon and Trout, and regulating fishing for Salmon and Trout, and for other purposes in the said section particularly mentioned:—
And whereas by the twelfth section of the said Act, the Governor is empowered, by Order in Council, under his hand and the public seal of the colony, from time to time, to delegate to the Superintendent or the Provincial Executive of any Province all or any of the powers vested in the Governor in Council by the said Act, subject to any limitations or restrictions, as he might think fit:—
And whereas the Governor did, with the advice and consent of the Executive Council of New Zealand, and in pursuance and in exercise of the powers and authorities for that purpose vested in him by the said Act, delegate to the Executive Government of the Province of Otago, all the powers vested in the Governor, or the Governor in Council, by the said Act, exercisable within the Province of Otago:—
And whereas by an Order in Council, made the eighteenth day of January, one thousand eight hundred and seventy, and published in the Otago Provincial Government Gazette, of the second day of February, one thousand eight hundred and seventy, No. 650, the Superintendent of the Province of Otago, with the advice and consent of the Executive Council of the said Province, made certain Regulations for the purposes mentioned in the second section of the said Act:—
And whereas it is expedient to rescind the said Regulations, so far as the same apply to the river Clutha and the mouth of the said river, as defined in section three of the said Regulations.
Now, therefore, His Honor, James Macandrew, Superintendent of the Province of Otago, with the advice and consent of the Executive Council of the said Province, by virtue and in exercise of the powers delegated to the Executive Council of the Province of Otago, and of every and any other power in anywise enabling the Provincial Executive in this behalf, doth hereby rescind the said Regulations of the eighteenth day of January, one thousand eight hundred and seventy, ... far as the same apply to the river Clutha or the mouth of the said river.

Members of the Executive Council of the Province of Otago, being also Members of the Provincial Council of the said Province.
WHEREAS by Proclamation bearing date the twenty-third day of June, one thousand eight hundred and sixty-eight, made by the Superintendent of the Province of Otago, with the advice and consent of the Executive Council of the said Province, and published in the Otago Provincial Government Gazette, No. 553, under the hand of the said Superintendent of the Province of Otago, and under the public seal of the said Province, certain Regulations were made for the depasturing of stock upon the Waste Lands of the Crown within the Otago Gold Field:—
And whereas it is expedient to make the following Regulations (in addition to those already in force) for the Waitahuna Depasturing District.
Now, therefore, His Honor, James Macandrew, Esquire, Superintendent of the Province of Otago, with the advice and consent of the Executive Council of the said Province of Otago, doth by virtue and in exercise of the powers delegated to the Executive Government of the Province of Otago in this behalf, hereby make the following Regulations for the said Waitahuna District:—
DEPASTURING REGULATIONS.
Otago Gold Field, Waitahuna District.

No bull over the age of six months, or entire horse over the age of twelve months, shall be depastured within the district without the permission in writing of a majority of the Board of Wardens first had and obtained.

It shall not be lawful to disturb or harass unnecessarily any stock depasturing within the district.

It shall not be lawful to remove cattle depasturing within the district unless twenty-four hours previous notice in writing shall have been given to the Board of Wardens, neither shall it be lawful to drive any cattle above the number of twenty through the district without such notice being given,
