BYE-LAWS of Wardens of Aparima Hundred for the

suppression of Trespass.

Passed 9th May, 1873.

  1. That no cattle of any description be depastured on the Crown lands of the Aparima hundred without a license. Provided, always, that horses and bullocks of bond fide travellers on their journey, when turned out, be not considered trespassers, if not longer than two nights in the same neighbourhood.

  2. That all persons not being licensed to depasture stock on the Aparima Hundred be required to remove their cattle and horses within fourteen days from the publication of this notice.

  3. That no sheep straying outside of any land be depastured on the Crown lands of the Hundred, unless on such portions of it as the Wardens from time to time shall direct and permit.

  4. That no entire horse over twelve months old be depastured on the Crown lands of the Aparima Hundred, and that no bull shall be allowed to run thereon, after fourteen days' notice to that effect has been given in writing to the owner thereof.

  5. That no license holder shall be allowed to depasture more than one head of great cattle, or four sheep for every eight acres stocked, and one head of great cattle or six sheep for every six acres of unenclosed land occupied by the same within the limits of the Hundred.

  6. That all license holders shall, within thirty days from the publication of this notice, furnish the Chairman of Wardens with the brands of the stock that they intend to run on the Hundred.

  7. That any stock depastured in contravention of any of the foregoing bye-laws, or bearing brands other than supplied by license holders to Chairman of Wardens, be impounded.

  8. That the penalty for any breach of the foregoing bye-laws be any sum not exceeding five pounds sterling (£5), to be recovered in a summary way, according to the 46th clause of the land regulations.

At a meeting of Wardens of the Oreti Hundred, held on the 9th June, 1873, the following additional bye-law was passed, viz.:—

That any person permitting needle-wood (the Crown lands within the Oreti Hundred) within having grown barriers or horses notice to be able to a tenant according to the Ranger shall be liable to a fine not exceeding £5, to be recovered in a summary manner, according to the 45th clause of the land regulations.

Tenth Schedule, in terms of section 65 of "Otago Waste

Lands Act 1872."

District of Clyde.

To the District Land Officers,
26th July, 1873.

I HEREBY GIVE NOTICE that I intend to construct a Water Race for irrigation and industrial purposes, commencing at a point on the Waikirikiri Creek, at the north boundary line of section 66, block II., of the Leaning Rock district; traversing the Waikirikiri Valley, and terminating at the Mataura District Farm, section 69, block II., of said Leaning Rock district. The length of said Race is three miles or thereabouts, and its intended depth and breadth of such Race is 20 inches by 20 inches, and it is capable of carrying two sluice heads of water; and I intend to construct a dam or reservoir on the course of said Race, on sections 35, 36, 37, block I., Leaning Rock, for the like purpose of irrigation and industrial area of said Reservoir about 14 acres; of a depth of ten feet by a breadth of 300 feet, and said dam will be capable of containing 600,000 gallons of water.

Any person objecting to the issue of a License to the above-mentioned applicant, must lodge his objection in writing at my office within thirty (30) clear days from the date hereof, and the hearing will take place on the 18th August next, if unopposed.

On the 27th day of July, 1873, by Mr. Thomas Brown, North-east Valley.

One brown gelding, aged, no visible brand.

Owner unknown, for trespassing on Mr. Brown's farm. Damages claimed, and to be deducted from sale proceeds if not claimed. The above gelding will be sold at the Public Pound, at Blueskin, on the 15th day of August, 1873, at 12 o'clock noon.

On the 15th day of July, 1873, by L. Moore, Shag Valley Station.

1 red and white cow, like Z M off company;
1 red and white heifer, no visible brand;
1 red and white calf, property of cow;
1 bay horse, no visible brand.

For trespassing on Coal Creek Station, for which four shillings damages are claimed, and in default of being released, the above cattle will be sold at the public pound, at Palmerston, on Friday, the 15th day of August, 1873, at 12 o'clock noon.

The horses impounded to be sold on like inst. will be sold on same date as cattle.

Election of a Councillor for High Ward, in room of Councillor Andrew Mercer, resigned, owing to his election as Mayor.

NOTICE is hereby given that the nomination of candidates for election to the office of Councillor for High Ward, in room of Councillor Andrew Mercer, resigned (elected Mayor), will be declared on Saturday, August 2nd, 1873, at the Terrace of the Provincial Council Chambers, Water street, at the hour of noon.

Nominations, in form of Schedule D of the "Otago Municipal Corporations Ordinance 1865," can be lodged at the Town Clerk's Office, Manse street, (where blank forms may be obtained), before noon of the day herein fixed for the declaration.
