Proceedings at Election of a Member of the Provincial Council of Otago declared valid.

ORDER IN COUNCIL.
At the Government House at Wellington, this second day of July, 1873.
Present:
His Excellency the Governor in Council.
WHEREAS by the sixty-seventh section of “The Regulation of Elections Act 1870,” it is enacted that no election shall be void in consequence only of there having been no Returning Officer at the time of the issue of the Writ, or of any delay in the return of the Writ; and where any accidental or unavoidable impediment, misfeasance, or omission shall have happened, the Governor in Council may take all such measures as may be necessary for removing such impediment or rectifying such misfeasance or omission, or may declare any or all of the proceedings at or for any election valid, as to and notwithstanding such impediment, misfeasance or omission; and every such Order in Council shall state specifically the nature of the impediment, misfeasance or omission, and shall be published in the New Zealand Gazette:
And whereas a Writ for the Election of a Member of the Provincial Council of Otago was issued on or about the twenty-second day of May last for the Electoral District of Moeraki: And whereas in accordance with the terms of the said Writ the election of a member for the said district was held on the nineteenth day of June last, but at the town of Hampden, within such district, the polling at such election took place in the Court-house there instead of at the School-house, which last-named house is and then was the duly appointed polling place for the election of members of the said Provincial Council: And whereas one Charles de Vere Teschemaker was declared by the Returning Officer at the said election to be duly elected thereat: And whereas it is expedient to declare the said election valid, notwithstanding the said irregularity, misfeasance, and omission:
Now therefore, His Excellency the Governor, in exercise and pursuance of all powers and authorities enabling him in this behalf, and with the advice and consent of the Executive Council of New Zealand, doth hereby declare all the proceedings at and for the said election valid as to and notwithstanding the hereinbefore recited impediment, misfeasance, and omission.
