MEETING OF THE PROVINCIAL COUNCIL

PROCLAMATION.

By His Honor James Macandrew, Esquire, Superintendent of the Province of Otago.

IN pursuance of the power and authority vested in me in that behalf, I do hereby fix and proclaim that the Thirty-second Session of the Provincial Council of the Province of Otago, shall be holden within the Provincial Council Hall, Dunedin, in the said Province, and shall commence upon Monday, the 30th day of June, 1873, at 12 o’clock noon; and the Members of the said Council are hereby warned to give their attendance at such time and place accordingly.

The First Schedule above referred to.

Tuapekas depasturing district comprises all that area situate in the Otago Gold Field, being parts of Runs numbered respectively 52, 53, and 54; bounded towards the north by Run 353; towards the east by Runs numbered respectively 259, and 52c; towards the south-east by the north-western watershed of the Waitahuna river towards the south-west by Run 106; and towards the west by Runs numbered respectively 123 and 137.

The Second Schedule above referred to.

Waitahuna depasturing district comprises all that area situate in the Otago Gold Field, being parts of Runs numbered respectively 53 and 54; bounded towards the north-west by Tuapekas depasturing district; towards the east by the eastern boundary of Run 53; towards the north-east by the north-eastern boundary of Run 53; towards the south-east by the North Tokomairiro hundred; and towards the south-west by the south-western boundary of Run 54.

NOTICE

Notice is hereby given, that in conformity with the "Depasturing Regulations," the first election of Wardens for the depasturing district of Waitahuna will be held on Friday, the 1st day of August next ensuing. The Board of Wardens for the district aforesaid shall consist of five elective members, one of whom shall hereafter be appointed chairman.

The following regulations shall be the regulations for the first election as aforesaid:-

I. Nominations of candidates must be made in writing, addressed to the Warden at Lawrence, on or before Monday, the twenty-eighth day of July next ensuing, and in the following form, which must be signed in full by the proposer and seconder of every such candidate.

FORM.

To the Warden at Lawrence.

We hereby nominate (here insert name in full) to be a member of the first Board of Wardens of the Waitahuna Depasturing District.

  • After the signatures of the proposer and seconder, the nature and particulars of the qualification under which they claim to vote must be stated.

II. If more than the requisite number of candidates are nominated, a poll shall take place on Friday the 1st August, from 10 a.m. till 4 p.m., and after the latter hour no further vote shall be allowed to be recorded; and the candidates in whose favor the greatest number of votes shall have been recorded at the said hour of 4 p.m., or, in the event of their not being more than the requisite number, then the candidates nominated shall, as soon thereafter as may be, be declared by the Warden, or other officer, to have been duly elected for the ensuing six months.

III. No person shall be entitled to be nominated, nor shall any person be entitled so to nominate, or to second the nomination of any candidate, unless he shall be possessed of one or other of the qualifications set forth and specified in Regulation No. 5 of the said regulations.

IV. If any person shall improperly be elected as a member of the Board of Wardens, he not being duly and lawfully possessed of the qualification aforesaid at the time of election, it shall be in the power of the Board, upon due inquiry into all the circumstances of the case, to declare by a majority of votes that such election is null and void, and thereupon an election shall be held when, where, and as may be determined by the Board, for filling up the deficiency caused by such declaration.

V. Voters must attend in person to record their votes, and the document by virtue whereof they claim to vote must be produced to the Warden or presiding officer, who after recording the vote shall cause to be written upon some conspicuous part thereof the words "Voted, August 1st, 1873," together with his signature or initials.

VI. The poll (if taken) will be held at the Courthouse at Waitahuna, and at the Schoolhouse, Manuka Creek.

VII. The names of all the candidates nominated shall be advertised in the local papers, and set forth in a Notice affixed to the front of the Courthouse.

OTAGO ROADS ORDINANCE, 1871.

Alteration of Polling Places.

WHEREAS by notice and appointment dated the eighteenth day of June, 1872, published in Otago provincial Gazette, the polling places for the respective districts and subdivisions of districts therein mentioned, under and by virtue of the "Otago Roads Ordinance 1871," were duly fixed and appointed until the same shall be altered or varied: And whereas it is expedient that the polling place in the district and subdivision of district after mentioned should be altered:

Now therefore I, James Macandrew, Superintendent of the Province of Otago, do hereby revoke the appointment of the polling place for the district and subdivision after-mentioned made by the notice and appointment dated the 18th day of June, 1872, and in lieu thereof do hereby appoint the place after-mentioned to be the polling place for the district and subdivision of district herein mentioned, at which the poll shall be taken at all elections under the "Otago Roads Ordinance 1871," held for the same until duly altered or varied, of which notice is hereby given to all concerned:-

Oteramika One Tree Point Subdivision, the house of Mr. A. McKenzie, Oteramika.

PUBLIC NOTIFICATION.

IN conformity to the 29th section of the "Gold Fields Act 1866," and to the Regulations made under that Act and the Gold Fields Acts Amendment Acts of 1867, 1868, and 1869, for the granting of leases for gold mining purposes within the Province of Otago, it is hereby notified that it is intended to grant a lease for gold mining purposes of Crown Lands to the applicant specified in the annexed Schedule, unless there shall be valid objections against granting such lease.

Objections to the granting of such lease, stating the grounds of objection, must be made in writing and lodged with the Warden at Queenstown, on or before the 27th day of June, 1873.

Copy of the application made, and plans annexed, may be seen at the Warden's Office at Queenstown.

William Duncan, for two acres of land, more or less, as the same may be found after survey to be within the pegs and trenches of the applicants, situated at Old Man Creek, 200 yards above Junction, Skippers.
