January one thousand eight hundred and seventy and published in the Otago Provincial Government Gazette (No. 646) on the fourteenth day of January one thousand eight hundred and seventy the Executive Government of the Province of Otago did make certain regulations for the purposes specified in the said thirty-ninth section of the said “Gold Fields Act 1866” And whereas by another Order in Council dated the twenty-eighth day of October one thousand eight hundred and seventy and published in the Otago Provincial Government Gazette (No. 701) on the thirtieth day of November one thousand eight hundred and seventy the Executive Government of the Province of Otago did revoke No. 4 of the said Regulations so made and published as aforesaid and did substitute another regulation in lieu thereof And whereas it is expedient to revoke the said last-mentioned regulation and to substitute in lieu thereof the regulation following:
Now therefore His Honor James Macandrew Superintendent of the Province of Otago by and with the advice of the Executive Council of the said Province and by virtue and in exercise of the powers delegated to the Executive Government of the said Province in this behalf by His Excellency the Governor of New Zealand in Council under the authority of the “Gold Fields Act Amendment Act 1867” and of any and every other power in any wise enabling the Executive Government of the Province of Otago in this behalf doth hereby order that the said Regulation so made by the said Order in Council of the twenty-eighth day of October one thousand eight hundred and seventy as aforesaid shall from and after the day of the date hereof be revoked and with the advice and consent aforesaid and by virtue and in exercise of the powers aforesaid doth hereby make the following regulation for the Otago Gold Field prescribing the manner in which the Warden shall deal with applications for Agricultural Leases for Land within the said Gold Field.

REGULATION RELATING TO AGRICULTURAL LEASES IN THE OTAGO GOLD FIELD.
Application to be recorded—Day fixed for hearing—Mode of procedure when more than one applicant for land.
REGULATION 4.
a. The Warden shall cause every application for an Agricultural Lease to be recorded in a book to be kept for that purpose and shall appoint a day being not less than fourteen nor more than thirty days from the date of the receipt of such application for hearing and deciding the same and any objections that may be made thereto.
b. If the Warden on such hearing as aforesaid shall find that more than one application has been made for a lease of the same land on the same day and shall find that no valid objection exists to the issuing of a lease of such land or some portion thereof the right to the lease of such land or of such part thereof as the Warden shall decide to grant shall be determined by lot in manner following:
c. On the day following that on which the decision of the Warden shall be arrived at the applicants shall at end before the Warden at noon and the Warden shall in the presence of the applicants or such of them as shall be in attendance in person or by agent prepare twice as many ballot tickets as there shall have been applications for the lease. The ballot tickets shall be as nearly as may be two inches square and shall be numbered consecutively from one (1) upwards and being so numbered shall be folded in such a manner as to conceal the numbers thereon and to be as nearly as possible of equal size shape and appearance.
The ballot tickets so prepared shall be placed in a box and shall be drawn therefrom by the applicants who shall be in attendance as aforesaid in turns one ticket only being drawn at a time and the applicant who draws the ticket marked with the highest number shall be entitled to the lease of the land.
If only one applicant shall be in attendance at the time appointed for the ballot no ballot shall take place but such applicant shall be entitled to the lease. All applicants not in attendance in person or by agent as aforesaid at the time appointed for the ballot shall be deemed to have withdrawn their applications.
PROCLAMATION.
By His Honor James Macandrew, Superintendent of the Province of Otago.
WHEREAS by an Ordinance passed by the Superintendent and Provincial Council of the Province of Otago, intituled the “Otago Roads Ordinance 1865,” it is amongst other things enacted that, until otherwise provided, pursuant to the provisions of the said Ordinance, there should be sixty-one Districts, which should be named as specified in the Schedule to the said Ordinance, annexed; marked B; And it is also by the said Ordinance provided, that it should be lawful for the Superintendent, with the advice and consent of the Otago General Road Board, from time to time, by proclamation in the Gazette, to alter, vary, diminish, or enlarge the boundaries of any or all of such districts, and to increase the number of Districts by forming and naming new Districts;
And whereas it is expedient to form seven new Road Districts, to be named respectively as hereinafter specified:
Now therefore, I, James Macandrew, Superintendent of the Province of Otago, with the advice and consent of the Otago General Road Board, do hereby proclaim and declare that from the day of the date hereof there shall be seven new Road Districts, to be named respectively the
Waimatuku Road District,
Jacob’s River Road District,
Aparima Road District,
Oteramika Road District,
New River Road District,
West Waikivi Road District,
Gap Road District;
And that the Waimatuku Road District shall comprise all that area in the Jacob’s River Hundred: bounded towards the north-east by the north-east boundary of Block XVI, Jacob’s River Hundred; on the east by the Waimatuku stream; on the south by the ocean; and on the west by Jacob’s River to the Yellow Bluff, excluding the township of Riverton and the Native Reserve.
The Jacob’s River Road District shall comprise all that area in the Jacob’s River Hundred, bounded on the north by the northern boundary of the Jacob’s River Hundred; on the east by the Jacob’s River; on the south by the Jacob’s River estuary; and on the west by the Purapurokino River and the western boundary line of Blocks Nos. XIII and VIII, Jacob’s River Hundred.
The Aparima Road District shall comprise all that area contained in the Hundred of Aparima.
The Oteramika Road District shall comprise all that area in the Mabel, Lothian, Mataura, and Oteramika Hundreds: bounded towards the north-east by the main Dunedin road from Woodlands to block IV, Lothian Hundred; on the north by the north boundary of block XXXV, Lothian Hundred continued due east to the Mataura River; on the east by the Mataura River; on the south by the south boundary lines of blocks XI, VII, and VI, Oteramika Hundred; and on the west by the east boundary line of the Invercargill Hundred. To include the township of Dacre.
The New River Road District shall comprise all that area in the New River Hundred: bounded on the north
