Provincial Notices and Proclamations




By virtue of the one hundred and ninth section of the said last-mentioned Act, may be delegated by the Governor in Council, to have, hold, and exercise the said powers within the said Province of Otago: And whereas the said lands hereinafter described are Crown Lands, subject to be dealt with under the provisions of the said sixteenth section of the “Gold Fields Act 1866,” and the said lands are now, or lately were, held in occupation by Messrs. Charles Crofton Boyes, and Frank Campbell Boyes, under License No. 345: And whereas the Executive Government of the Province of Otago have determined to cancel the said license as to so much and such part of the lands held under the same as are comprised within the area hereinafter described:

Now therefore, I, William Alexander Tolmie, Deputy-Superintendent of the Province of Otago, by and with the advice and consent of the Executive Council of the said Province, and by virtue and in exercise of the powers delegated to the Executive Government of the said Province in this behalf by His Excellency the Governor of New Zealand in Council, under the authority of the “Gold Fields Act Amendment Act 1867,” and of any and every other power in anywise enabling me in this behalf, do hereby cancel the said license, in so far as the lands comprised within the area hereinafter described are affected by the said license, but no further or otherwise (that is to say)—

All that area situate in the Province of Otago, containing by estimation two thousand acres, more or less, being part of Run numbered 345 on the map of the interior pastoral districts: bounded towards the north by Kawarau river, fourteen thousand nine hundred (14,900) links; towards the east by Blocks II and IV, Coneburn Survey District, twenty-seven thousand three hundred (27,300) links; towards the south by Block III, Coneburn District aforesaid, ten thousand (10,000) links; and towards the west by Block I, Coneburn District aforesaid, twenty thousand five hundred (20,500) links.

Given under my hand and issued under the Public Seal of the Province of Otago, at Dunedin, in presence of Donald Reid, George Duncan, and John L. Gillies, members of the Executive Council of the said Province, being also members of the Provincial Council thereof, this second day of August, one thousand eight hundred and seventy.

PROCLAMATION

Of His Excellency the Governor having assented to certain Ordinances of the Superintendent and Provincial Council of the Province of Otago.

By His Honor William Alexander Tolmie, Deputy-Superintendent of the Province of Otago.

WHEREAS in the Twenty-seventh Session of the Provincial Council of the Province of Otago the Bills next hereinafter mentioned were passed by the said Council—(that is to say):

A Bill shortly intituled “The University of Otago Endowment Ordinance 1870”;

A Bill shortly intituled the “Dunedin and Port Chalmers Railway Lands Compulsory Taking Ordinance 1870”;

And whereas the said Bills were severally presented to the Superintendent of the Province of Otago for the assent of His Excellency the Governor of New Zealand thereto, and the said Superintendent did upon the said several Bills being so presented to him as aforesaid, declare that he reserved the same respectively for the signification of the Governor’s pleasure thereon: And whereas the said several Bills have since been laid before His Excellency the Governor of New Zealand, and he has been pleased to assent to the same:

Now therefore, I, William Alexander Tolmie, Deputy-Superintendent of the Province of Otago, do hereby proclaim and declare that the said several Bills before-mentioned, that is to say—the “University of Otago Endowment Ordinance, 1870,” and the “Dunedin and Port Chalmers Railway Lands Compulsory Taking Ordinance 1870,” have been laid before His Excellency the Governor of New Zealand, and that His Excellency has assented to the same.

Given under my hand, and issued under the Public Seal of the Province of Otago, at Dunedin, in the said Province, this tenth day of August, one thousand eight hundred and seventy.

WARRANT

Appointing an Officer for the revision of the Citizens’ List and for other purposes in the Incorporated Town of Balclutha, in the Province of Otago.

WHEREAS the Town of Balclutha has been incorporated under the provisions of the “Otago Municipal Corporations Ordinance 1865;” And whereas by the 113th Section of the said Ordinance, it is amongst other things enacted that in cases where no special provision is made for the conduct of the first Elections under the said Ordinance, it should be lawful for the Superintendent of Otago to appoint such and so many persons as might be necessary to perform any of the said Acts in the said Ordinance, before required to be done by the Mayor, Councillors, Town Clerk, Collector, or other Officers, before such Officers could be appointed or elected under the provisions of the said Ordinance: And whereas by the 40th Section of the said Ordinance, the Mayor and Councillors of any Town incorporated under the said Ordinance (in the said section called the Council), are constituted open Courts for the revision of the Citizens’ Lists and for hearing and determining the claims of the Citizens thereof to be inserted in such Lists, and the objections of such Citizens to any other Citizen having his name retained thereon: And whereas it is expedient to appoint a fit and proper person to perform the acts required to be done by the Mayor and Councillors, as constituting Courts of Revision under the said 40th Section of the said Ordinance, and to do the several other matters and things directed and required by the said Ordinance in the revision of the Citizens’ List for the said Incorporated Town of Balclutha;—

Now therefore I, W. A. Tolmie, Deputy-Superintendent of the Province of Otago, in exercise of the powers vested in me by the said “Otago Municipal Corporations Ordinance 1865,” and of all other powers in any wise enabling me in this behalf, do hereby nominate and appoint

HENRY SMYTHIES, Esquire,

to perform the acts required to be done by the Council in the revision of the Citizens’ List for the Town of Balclutha, and hearing and determining the claims of the Citizens thereof to be inserted in such List, and the objections of such Citizens to any other Citizen having his name retained thereon.
