Section 13 of the Otago Waste Lands Acts 1866 Amendment Act 1869.

Any cattle found depasturing on a Hundred, not being the property of, or in the custody of a license holder, or depasturing on the Hundred in contravention of these Regulations, may be impounded, and the owner or custodian of such cattle shall forfeit and pay for every such offence the sum of £5, to be recovered in a summary way.

Any person disturbing or harassing cattle, great or small, depastured within any Hundred, shall be liable to a penalty of £5, to be recovered in a summary way, provided always that any person holding a license to depasture cattle within the Hundred, or any person duly authorised by him, may drive cattle so depastured for the purpose of collecting such of them as may belong to him, and for the legitimate use of the right to pasture within the Hundred; but in case it should be necessary for such purpose to drive any cattle belonging to any other person a greater distance than one mile, the person so driving such cattle must take them to the nearest stock-yard, and there separate his own cattle from those of other persons, and return the latter to the place from whence they were driven.

No person shall remove cattle from beyond the boundary of any Hundred other than those belonging to him or for the removal of which he shall have due authority, under a penalty of £20, to be recovered in a summary way.

Any person shooting cattle on any Hundred without the consent in writing of the Waste Land Board previously obtained, shall be liable to a penalty of £20, to be recovered in a summary way.

Any person who shall set fire to any herbage or grass upon the Crown Lands within any Hundred, without the consent in writing of the Chief Commissioner of the Waste Land Board previously obtained, shall forfeit and pay for every such offence the sum of £5, to be recovered in a summary way; but such consent will not protect any person from the consequences of any loss or damage which may be sustained by any person by reason of the carelessness with which such burning of the Hundred may be performed.

The Waste Land Board may appoint one or more Rangers for each Hundred, whose duty shall be to see that these Regulations are carried into effect, and to report any neglect or breach thereof to the Waste Land Board.

The word cattle, in these Regulations, shall mean all animals included within the meanings attached to great and small cattle by the “Otago Waste Lands Act 1866,” and shall include, except where the context clearly shows a contrary intention, a single head of great or small cattle, as well as any larger number.
