ORDER IN COUNCIL.
At the Provincial Government Buildings, Dunedin, the twenty-sixth day of June, one thousand eight hundred and sixty-eight.
Present:
His Honor the Superintendent;
The Provincial Secretary and Treasurer; and
The Secretary of Land and Works,
Members of the Executive Council of the Province of Otago.
WHEREAS by an Order in Council, bearing date the fifteenth day of April, one thousand eight hundred and sixty-eight, made by His Honor James Macandrew, Esquire, Superintendent of the Province of Otago, by and with the advice and consent of the Executive Council of the said Province, and by virtue and in exercise of the powers delegated to the Executive Government of the said Province of Otago in that behalf under the provisions of “The Gold Fields Act 1866,” certain Regulations were made for the Otago Gold Field, and amongst others certain Regulations regulating Residence Areas contained in number XVII of the said Regulations: And whereas it is expedient to add an additional provision to said Regulation number XVII, providing for the refusal of applications for Residence Areas, when deemed advisable:
Now, therefore, His Honor James Macandrew, Esquire, Superintendent of the Province of Otago, by and with the advice and consent of the Executive Council of the said Province, and by virtue and in exercise of the powers delegated to the Executive Government of the said Province of Otago in this behalf doth hereby make the Regulation following, in addition to the said Regulation number XVII; and doth hereby order that from and after the day of the date hereof, the Regulation following shall be in force on the Otago Gold Field in addition to the Regulations made by the Order in Council, bearing date the fifteenth day of April, one thousand eight hundred and sixty-eight, (that is to say)
REGULATION XVII.
RESIDENCE.
- Application may be refused or referred to the final decision of the Executive Government.
Notwithstanding anything to the contrary contained in Section 2, of Regulation XVII, it shall be lawful for the Warden, in his discretion, to refuse to grant a Residence Certificate to any applicant (even although no objection may have been entered thereagainst) if it shall be within the knowledge of such Warden that the Land applied for is, or is believed to be auriferous; or if such Warden shall deem it undesirable, on public grounds, that such certificate should be granted: And it shall also be lawful for the Warden, in his discretion, instead of refusing any application, to refer the same for the consideration of the Executive Government, and the Warden shall grant or refuse such application according to the decision arrived at by them.

NOTICE TO POUNDKEEPERS.
Poundkeepers who have neglected to comply with the conditions of the “Impounding Ordinance 1862,” clauses 8 and 24, will be liable to be proceeded against under clause 33 for the recovery of the penalty thereby provided.
