Teschemaker

Do forthwith cede and deliver, convey and assign unto the said Martin Sholl, his heirs, executors, administrators, and assigns, according to the nature and quality thereof respectively, all the estate and effects of the said Charles de Vere Teschemaker, upon trust, for the purpose of selling, disposing of, getting in, and receiving or otherwise realising the same, and in the first place paying, satisfying, and discharging all costs, charges, and expenses incurred by order of this Court, or incidental to the execution of the trusts of the conveyance and assignment to be made in pursuance of this order, and all fees of Court and other fees (if any) payable under the said "Debtors and Creditors Act, 1858," or the "Debtors and Creditors Act Amendment Act, 1865," and such other sums of money (if any) as shall be ordered by this Court, and five pounds per cent. commission, as in the said order mentioned, and subject, as aforesaid, for the purpose of justly distributing and administering the clear residue of the said monies between and amongst and for the benefit of all the Creditors of the said Charles de Vere Teschemaker, at the time of the presentation of his said Petition, and who have duly proved their debts by affidavit, in accordance with the rules of this Court, within six calendar months from the date of the said deed of the first day of August, one thousand eight hundred and sixty-five, or who have or shall prove their debts within such further time as in the said order mentioned, by way of pro rata distribution, subject to existing legal priorities; and if there shall be any surplus of the said monies after answering the purposes aforesaid, shall pay such surplus to the said Charles de Vere Teschemaker: And I further order, that the Registrar of this Court at Dunedin shall make and execute such cession and delivery, conveyance and assignment, in the name and on behalf of the said Charles de Vere Teschemaker, and that the conveyance and assignment hereby directed to be made shall contain all requisite powers for enabling the said Martin Sholl to recover and receive debts, monies, goods, chattels, estate, and effects in any way belonging to or due and payable to the said Charles de Vere Teschemaker.

The following Certificate and Declaration are published in conformity with the provisions of the "Execution of Criminals Act, 1858."

CERTIFICATE

I, Edward Hulme, the Medical Officer in attendance at the execution of John Jones, at the common gaol of Dunedin, do hereby certify and declare that I have this day witnessed the execution of the said John Jones at the said gaol; and I do further certify and declare that the said John Jones was, in pursuance of the sentence of the Supreme Court, hanged by the neck until his body was dead.

Given under my hand this sixth day of April, one thousand eight hundred and sixty-six, at the Gaol of Dunedin.

DECLARATION

We hereby testify and declare that we have this day been present when the extreme penalty of the law was carried into execution on the body of John Jones, convicted at the Criminal Session of the Supreme Court held at Dunedin on the fifth day of March last, and sentenced to death; and that the said John Jones was, in pursuance of the said sentence, hanged by the neck until his body was dead.

Dated this sixth day of April, in the year one thousand eight hundred and sixty-six, at the Gaol of Dunedin.

Subscriptions

Subscriptions will be at the rate of £1 per annum, or 5s. per quarter, payable in advance to the Publisher. Single copies of the Gazette not to exceed 6d.

Subscriptions can commence at any time, but must terminate not later than 31st December, 1866.

Private Advertisements will be charged at the rate of 6d. per line. Late Advertisements and table matter, 1s.

The Gazette (with Supplement) is published every Wednesday morning, and Notices for Insertion must be received at the Publisher’s Office not later than 2 o’clock p.m. on the Tuesday preceding. Advertisements received after that hour will be charged 1s. per line. Any irregularity in the receipt of those Gazettes which are given gratis by the Government should be reported at once to the Provincial Secretary.
