In the matter of the “Debtors and Creditors Act, 1862,” and in the matter of the Petition of John Russell Smith of Dunedin, in the Province of Otago, and Colony of New Zealand, Merchant, carrying on business in co-partnership with John Currie of Melbourne, in the Colony of Victoria, Merchant at Dunedin aforesaid, as Merchants under the style and firm of “Currie & Smith;”

Upon reading the Petition of the said John Russell Smith and the affidavit thereunto annexed, and upon hearing Mr. Bryan Cecil Haggit of Counsel for the said Petitioner; It is ordered that Robert Chapman Esquire, the Registrar of this Honorable Court at Dunedin aforesaid, do and shall, in the name and on behalf of the said Petitioner, convey, assign, and make over all the said Petitioner’s real and personal estate and effects, unto John Davie of Dunedin, aforesaid, Auctioneer, John Griffen of Dunedin, aforesaid, Merchant, and Percival Clay Neill, of the same place, Merchant, upon trust for the collection and conversion into money of the said estate and effects, and the distribution of the net proceeds pro rata, and subject to existing priorities (if any), amongst such of the Creditors of the said Petitioner as shall duly prove their respective debts by affidavit filed in the office of the Registrar of this Court, at Dunedin, aforesaid, within three calendar months from the date of this order, and upon and subject to such other trusts and provisions as the said Court may, at or before the final hearing of the said Petition, direct or approve.

In the matter of the Petition of Alfred John Talbot, of Dunedin, in the Province of Otago, Accountant, a Debtor, and in the matter of the Petition of Robert Murray, of Dunedin, in the Province of Otago, aforesaid, Gentleman, a creditor of the said Alfred John Talbot, to the extent of not less than fifty pounds; and in the matter of the “Debtors and Creditors Act, 1862.”

Upon reading the Petition of the said Alfred John Talbot, and the affidavit thereunto annexed, and upon hearing Mr. Bryan Cecil Haggit of Counsel for the said Petitioner; It is ordered that Robert Chapman Esquire, the Registrar of this Honorable Court at Dunedin, aforesaid, do and shall, in the name and on behalf of the said Petitioner, convey, assign, and make over all the said Petitioner’s real and personal estate and effects, unto James H. Shepherd of Dunedin, aforesaid, Commission Agent, upon trust, for the collection and conversion into money of the said estate and effects, and the distribution of the net proceeds pro rata, and subject to existing legal priorities (if any), amongst such of the Creditors of the said Petitioner as shall duly prove their respective debts by affidavit, filed in the office of the Registrar of this Court, at Dunedin aforesaid, within three calendar months from the date of this order, and upon and subject to such other trusts and provisions as the said Court may, at or before the final hearing of the said Petition, direct or approve.

PROCLAMATION.

By His Honor Samuel Bealey, Esq., rescinding a certain Proclamation under “The Diseased Cattle Act, 1861.”

WHEREAS on the 23rd day of September, 1865, I, Samuel Bealey, Superintendent of the Province of Canterbury, did, by virtue of the powers vested in me in that behalf, issue a Proclamation declaring certain Districts to be infected Districts under “The Diseased Cattle Act, 1861,” and making certain regulations for the destruction of diseased cattle, and for the preventing the removal or transportation of cattle from the said infected Districts into the Province of Canterbury. Now therefore I, Samuel Bealey, Superintendent as aforesaid, do hereby rescind the said Proclamation.

Given under my hand, and issued under the public seal of the Province, at Christchurch, this twenty-seventh day of November, one thousand eight hundred and sixty-five.

PROCLAMATION.

By His Honor Samuel Bealey, Esq., Superintendent of the Provinces of Canterbury, appointing Quarantine Ground under “The Diseased Cattle Act, 1861.”

WHEREAS by an Act of the General Assembly of New Zealand, intituled “The Diseased Cattle Act, 1861,” it is (inter alia), enacted that the Governor might by order in Council, from time to time appoint places for quarantine grounds under the said Act, and make regulations for the management of such quarantine grounds, and fixing the fees and charges thereof; and for the destroying of diseased cattle, and for landing and driving of cattle under the said Act, and generally for regulating and enforcing the performance of duties thereby imposed on Inspectors and on Masters of ships or vessels.

And whereas the Governor in Council hath by warrant under his hand delegated to me, Samuel Bealey, so long as I shall hold the office of Superintendent of the Province of Canterbury, the several powers vested in the Governor by the second, fourth, fifth, seventh, ninth and tenth sections of the said Act, subject to being rescinded as in the said Act is provided, and subject to the regulations issued by the Governor in Council.

Now, therefore, I the said Samuel Bealey, by virtue of the powers vested in me, do hereby appoint that portion of the Province of Canterbury, to the west of the dividing range, to be a quarantine ground under the said Act.

Given under my hand, and issued under the public seal of the Province, at Christchurch, this twenty-seventh day of November, one thousand eight hundred and sixty-five.
